HomeMy WebLinkAboutCity of Tamarac Resolution R-86-044e Introduced by:4A Temp. #3986 1 2 3 4 S 7 8 9 IQ 11 12 13 14 15 16 17 21 22 23 24 2S 26 I 27 28 29 30 CITY OF TAMARAC, FLORIDA RESOLUTION NO.R-86-/-//4/ A RESOLUTION CONCERNING PROPOSED CAPITAL EXPENDITURES, AFFECTING RESIDENTS SERVICED BY TAMARAC UTILITIES WEST (ALL RESIDENTS WEST OF STATE ROAD 7 IN TAMARAC) PROPOSING AN EXPEND- ITURE FOR THE DESIGN AND INSTALLATION OF FIVE (5) FRESHWATER DRINKING WELLS AT MIDWAY PLAZA IN AN AMOUNT OF EIGHT HUNDRED THOUSAND DOLLARS ($800,000); PROPOSING AN EXPENDITURE FOR THE DESIGN AND RELOCATION OF WATER AND WASTEWATER UTILITY PIPES TO ALLOW FOR THE WIDENING OF UNIVERSITY DRIVE IN AN AMOUNT OF ONE MILLION THREE HUNDRED THOUSAND DOLLARS ($1,300,000); AND PROPOSING AN EXPENDITURE FOR THE DESIGN OF IMPROVEMENTS TO FACILITIES AT THE NORTHWEST 61ST STREET DRINKING WATER PLANT IN AN AMOUNT OF TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000); PROVIDING FOR A REFERENDUM TO BE HELD ON MARCH 11, 1986; PROVIDING THAT IF A MAJORITY OF THE VOTERS APPROVE A PROPOSED EXPENDITURE THEN UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS THE APPROPRIATE CITY OFFICIALS SHALL BE AUTHORIZED TO MAKE THE EXPENDITURE OF THE APPROVED FUNDS FOR THE APPROVED PROJECT; PROVIDING FOR SEVERABILITY OF INVALID PROVI- N • AND DINg_AN UFECTIVE DATFs_.___ WHEREAS, Section 7.13 of the City Charter requires referendum approval by the voters for any appropriation of City funds for capital expenditures in excess of one and one- half percent (1.5%) of the current budget (for the 1985-86 budget this affects such expenditures in excess of $150,555); and WHEREAS, the City Council has determined that the pro- posed capital projects and improvements are in the best interests of the residents serviced by Tamarac Utilities West. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the following proposed expenditures are to be presented to the electorate of the City of Tamarac serviced by Tamarac Utilities West (all precincts except 11J and 17J), at the March 11, 1986 election and if the proposed expenditure is approved by a majority of the electorate at said election the appropriate city officials shall be author- ized to make the expenditure of the approved funds for the approved capital projects and improvements. UU -1- PROPOSED CAPITAL EXPENDITURE #1 — MIDWAY PLAZA POTABLE WATER WELLS (UNIVERSITY DRIVE AND N.W. 57 STREET). A capital expenditure is proposed for the design and installation of five (5) water wells for drinking water at Midway Plaza in order to increase the City's available supply of potable water. Construction is needed at this time to coincide with development of the Shopping Center. Funds for this project would come from impact fees collected by the City in an amount not to exceed eight hundred thousand dollars ($800,000) as may be needed. ARE YOU IN FAVOR OF AUTHORIZING THE CITY COUNCIL TO 4-6191NOah7"i- �I11 _ Tim iiF�al i YES PROPOSED CAPITAL EXPENDITURE #2 -- RELOCATION OF UTILITY PIPES TO ALLOW FOR WIDENING OF UNIVERSITY DRIVE. A capital expenditure is proposed for the design and relocation of water and wastewater utility pipes along University Drive between Southgate Boulevard and Commercial Boulevard. The relocation is needed to allow for widening of University Drive. (Existing asbestos cement pipes must be removed.) Funds for this project, would come from impact fees collected by the City and other available revenues in an amount not to exceed one million three hundred thousand dollars ($1,300,000) as may be needed. ARE YOU IN FAVOR OF AUTHORIZING THE CITY COUNCIL TO PROCEED WITH THIS CAPITAL PROJECT? YES VU —2— 0 PROPOSED CAPITAL EXPENDITURE #3 - DESIGN ONLY OF DRINK- ING WATER PLANT EXPANSION AND IMPROVEMENTS. A capital expenditure is proposed to prepare final design drawings and construction contract documents for the rehabilitation and expansion of the potable water treatment plant to comply with updated state health requirements. Funds for this project would come from impact fees collected by the City and other available funds in an amount not to exceed two hundred fifty thousand dollars ($250,000). Approval for the actual construction will be proposed in a future referendum. ARE YOU IN FAVOR OF AUTHORIZING THE CITY COUNCIL TO PROCEED WITH THE DESIGN OF THIS PROJECT? YES 0i1 SECTION 2: Should any section or provision of this resolution or any portion hereof or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 3: This resolution shall become effective immediately upon its adoption, and the appropriate City UU -3- officials are authorized to take whatever actions are necessary to see that this matter is placed on the March 11, 1986 ballot.
