CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-86-
A RESOLUTION APPROVING AND AUTHORIZING EXECU-
TION OF AN AGREEMENT WITH PINES AT WOODMONT
CONDOMINIUM ASSOCIATION INC. (TRACT 55)AND
PR VIDING AN EFFECTIVE DATE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA
SECTION 1: That the Agreement with Pines at Woodmont Con-
dominium Association, Inc., for the City to alleviate flooding
problems by regrading the swale area of the driveways of certain
residences located within Woodmont Tract 55 is HEREBY APPROVED, a
copy of which is attached as Exhibit "l".
SECTION 2: That the appropriate City officials are hereby
authorized to execute said agreement on behalf of the City.
SECTION 3: This Resolution shall become effective immedi-
ately upon adoption.

AGREEMENT
THIS AGREEMENT, made and entered into this day of
1986, by and between:
CITY OF TAMARAC, a municipal corporation of
Florida, hereinafter referred to as "CITY"; and
PINES AT WOODMONT CONDOMINIUM ASSOCIATION, INC.
TRACT 55, a condominium association, hereinafter
referred to as "ASSOCIATION".
WHEREAS, certain homeowners of the ASSOCIATION are ex-
periencing flooding problems in the swale area of their
driveways; and
WHEREAS, the CITY desires, for the mutual benefit of
both parties, to alleviate the drainage problem by entering
into this agreement with the ASSOCIATION; and
WHEREAS, pursuant to Resolution 86-A L., adopted on
a7 , 1986, the proper CITY officials are hereby
authoriz d and directed to execute this agreement;
NOW, THEREFORE, in consideration of the mutual covenants
and undertakings of the parties hereto and other good and
valuable considerations, the parties hereto covenant and
agree each with the other as follows:
(1) The CITY will provide all labor, materials, and
equipment for the regrading of the swale area of the
driveways according to the specifications described in the
attached Exhibit A, for the following 60 residences located
within the PINES AT WOODMONT (TRACT 55):

(2) The ASSOCIATION has paid as a deposit
against'actual costs which will be computed by the CITY at
0 completion of the work. Final payment if any, shall be paid
within ten days of receipt by the ASSOCIATION of CITY's
invoice. The CITY shall complete its work agreed by this
agreement on or before _June l,_ 1986.
(3) The ASSOCIATION will be responsible for any "seal -
coating" desired, at no cost to the CITY.
(4) The ASSOCIATION agrees to waive all and any war-
ranties, expressed or implied, as to the CITY's performance

under this Agreement. The ASSOCIATION further agrees to hold
harmless the CITY for any consequential damage to persons or
property resulting from any inadequate or negligent perfor-
mance by the CITY under this Agreement.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed on the day and year first hereinabove
written.
