CITY OF TAMARAC, FLOPIDA
RESOLUTION R-85-7Z
A RESOLUTION REGARDING WOODMONT TRACT 24,
PROVIDING FOR THE REFUND OF CERTAIN FEES
.AND _2RQVIDING_AN F T _V.E_ A-TF.L,__
WHEREAS, Tract No. 24 Associates obtained final site
plan approval for the development of Woodmont Tract 24 from
the City Council on June 14, 1985 and paid the necessary fees
at that time; and
WHEREAS, Tract No. 24 Associates has petitioned the City
Council for a refund of said fees based upon its present
plans not to proceed with the development and since the plat
has not been approved or recorded by the Broward County
Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION_1: That the following fees are hereby
refunded and the Finance Director is authorized and directed
to issue checks paid to the order of Tract No.24 Associates
for the following items:
A. $172,890.00 as refund for CIAC charges on 113
ERC's.
B. $ 2,093.00 as a refund for drainage improve -
fee.
C. $ 23,814.00 as a refund for water retention
fee.
09T19X-2: That the plat is hereby voided.
BZQTION 3: That the site plan is hereby voided.
SECTION 4: That Resolution R-85-259 approving
development order number 124 approving the site plan for
Tract 24 is hereby repealed.
bECTTONa: That second Amendment to the June 14, 1985
Water and Sewer Developer's Agreement is hereby approved,
voiding the agreement.

imposed by the City Council:
A. No interest is claimed by the developer nor is
it granted by the City or any of thesc :cf:::dc.
B. The original water and sewer agreements to be
returned to the city.
SECT.JON_Z: That this Resolution shall become effec-
tive upon adoption.
