A RESOLUTION AUTHORIZING APPROPRIATE CITY

OFFICIALS TO EXECUTE ON BEHALF OF THE CITY AN
ASSIGNMENT OF DECLARATION OF RESTRICTIONS TO
MAINLANDS - SECTION 6 CIVIC ASSOCIATION, INC.,

REPEALING RESOLUTION NO. R-7--69; AND PROVIDING
AN EFFECTIVE DATES

WHEREAS, MAINLANDS - SECTION 6 CIVIC ASSOCIATION, INC., a

Florida corporation, has offered to accept an assignment from the
11
City of Tamarac, a municipal corporation of the State of Florida
12
of certain rights,
g privileges, duties and responsibilities on
13
lands within the City as more fully described in the Assignment of
14
Declaration of Restrictions attached hereto and incorporated by
1s
reference herein, and
16
WHEREAS, the Council of the City of Tamarac has considered
17
said offer and deems the same to be in the best interest of the
16
City.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
20
TAMARAC, FLORIDA:

. SECTION 1: That the City Council assigns to Mainlands -
22
Section 6 Civic Association, Inc., a Florida corporation, all
23
rights, privileges, duties and responsibilities received by the
24
City pursuant to that certain Assignment of Declaration of
Restrictions, attached hereto, and dated December 2, 1968 and
recorded January 14, 1969, in Broward County, Florida Official
27
Records Book 3835 at page 723 upon those lands specifically
26
described in the attached Assignment of Declaration of Restric-
29
tions.

SECTION 2: That the appropriate City officials are hereby
31
authorized and directed to execute an Assignment of said Assign-
22
ment of Declaration of Restrictions dated December 2, 1968 and
33
recorded January 14, 1969 in Broward County, Florida Official
34
Records Book 3835 at Page 726.

SECTION 3: That Resolution No. 7-69 of the City of Tamarac
shall hereby be repealed.
SECTION 4: This Resolution shall take effect immediately upon
adoption. PASSED, ADOPTED AND APPROVED thiso�6 day of _ % _, 1986.

THIS ASSIGNMENT, made in Broward County, Florida this
12L day of March, 1986, by and between:
CITY OF TAMARAC, a municipal Corporation of the State
of Florida, as Assignor
and
10 MAINLANDS - Section 6 Civic Association, Inc., a
Florida Corporation, as Assignee.
WHEREAS, Assignor received an assignment of certain
rights, privileges, duties and responsibilities from that
certain Assignment of Declaration of Restrictions dated the
2nd day of December, 1968 and recorded January 14, 1969, in
Broward County, Florida Official Records Book 3835, at Page
723; and
WHEREAS, Assignor desires to effect an assignment to
Assignee of any rights received by Assignor pursuant to that
Assignment of Declaration of Restrictions recorded January
14, 1969 in Broward County, Florida Official Records Book
3835, at Page 723;
WITNESSETH:
In consideration of the acceptance of this Assignment by
Assignee, the City of Tamarac, a municipal corporation of
Florida, hereby assigns, transfers and delivers to Mainlands
- Section 6 Civic Association, Inc., a Florida corporation,
all rights, privileges, duties and responsibilities received
by the City of Tamarac and contained within that certain
Assignment of and recorded January 14, 1969, in Broward
County, Florida Official Records Book 3835, at Page 723,
which Assignment of Declaration of Restrictions relates to
the following described lands, to -wit:
THE MAINLANDS OF TAMARAC LAKES SIXTH SECTION, according
to the plat thereof recorded in Plat Book 65, Page 46,
of the Public Records of Broward County, Florida; and
The following described tract of land situate, lying and
being in Broward County, Florida, to be hereafter
platted as THE MAINLANDS OF TAMARAC LAKES, SECTION 6A.
A portion of Tract 3 and 4 of Section 14, Township 49
South, Range 41 East, Broward County Florida, according
to the plat of FORT LAUDERDALE TRUCK FARMS SUBDIVISION
as recorded in Plat book 4, Page 31, of the Public
Records of Broward County, Florida, being more particu-
larly described as follows:
Commence at the Northwest corner of the MAINLANDS OF
TAMARAC LAKES, SIXTH SECTION; thence N-89 degrees 47'
00"-E, 1328.40 feet to a point; thence N-38 degrees 17'
30"-E, 506.81 feet to the Point of Curvature of a cir-
cular curve to the left; thence Northerly, along the
arc of said circular curve to the left; having a radius
of 145 feet, an arc distance of 194.47 feet to the Point
of Tangency of said curve; thence N--38 degrees 33' 14"
W, 101.04 feet to the Point of Curvature of a circular
curve to the left; thence Northwesterly, along the arc
of said curve, having a radius of 626.93 feet, an arc
distance of 553.68 feet to the Point of Tangency of said
curve, thence N-89 degrees 09' 25"-W, 967.55 feet to a
point; thence N-0 degrees 13' 00"-W, 249.58 feet to the

In consideration of the foregoing Assignment,
and other valuable and sufficient consideration, the receipt
and adequacy of which is hereby acknowledged, MAINLANDS -
SECTION 6 CIVIC ASSOCIATION, INC., a Florida corporation,
hereby accepts the same and hereby agrees, to undertake and
assume the rights, privileges, duties and responsibilities of
the foregoing referred to reservations and servitudes. This
Acceptance of Assignment is executed by the undersigned as
authorized by Resolution of the Board of Directors of the
MAINLANDS - Section 6 Civic Association, Inc., adopted the

together with all rights, privileges, duties and obligations
thereunto appertaining, provided, however, that in the event
Assignee shall, for any reason whatsoever, fail, neglect or
refuse to exercise any of the rights, privileges, duties or
obligations or any part thereof, contained in said restric-
tions and serviture, Assignor, may, in its sole discretion
and option by instrument duly recorded among the Public
Records of Broward County, Florida, reassume said rights,
privileges, duties or obligations, or any part thereof, which
Assignee has failed, neglected or refused to exercise.
The Assignor and the Assignee further agree and acknow-
ledge that the City of Tamarac, as Assignor, shall hereafter
be fully discharged from any and all obligations, rights and
duties created by said Declaration of Restrictions and that
said Assignment as conveyed and granted without recourse to
the Assignor.
IN WITNESS WHEREOF, CITY OF TAMARAC, a municipal
corporation of the State of Florida, has caused this
assignment to be executed by its Mayor, its corporate seal
fixed, and attested by its Clerk, this .3 d day of
