CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-84-76
A RESOLUTION AUTHORIZING RELEASE OF A CASH
BOND POSTED FOR PATIO HOMES AT FAIRMONT
TEMPORARY PLATTING WAIVER; ACKNOWLEDGING
CANCELLATION OF CERTAIN RELATED AGREEMENTS;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Toll Development Corporation -Fairmont, posted a
$3,500.00 cash bond as security for construction and demolition of
models at Patio Homes at Fairmont, Units 1 through 4, as a condition
for approval of a temporary platting waiver; and
WHEREAS, the terms of the Cash Bond Agreement, Hold Harmless and
License Agreement by Toll Development Corporation -Fairmont, for Patio
Homes at Fairmont temporary platting waiver and models have been
complied with, thereby voiding the agreements; and
WHEREAS, the City Council wishes to release the cash bond and
acknowledge cancellation of the Cash Bond Agreement, Hold Harmless
and License Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA:
SECTION 1: That the Cash Bond Agreement, Hold Harmless and
License Agreement are hereby null and void.
SECTION 2: That the cash bond in the amount of $3,500.00 posted
as a condition for approval of a temporary platting waiver is hereby
released, less the amount of $300.14 which is due and owing the City
in connection with the Water and Sewer Developers Agreement for this
project.
SECTION 3: This Resolution shall become effective upon adoption.
PASSED, ADOPTED AND APPROVED this 14th day of March, 1984.
