4 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER
NO. 01-3 FOR A REVISED SITE PLAN FOR ASHMONT/
t KINGS POINT; AND PROVIDING AN EFFECTIVE DATE.
b WHEREAS, pursuant to the instructions of the City Council

of Tamarac, Florida, a public meeting has been advertised in accokd-
e
ance with applicable law of the date, time and place of the meeting
9
regarding the review of the application for a revised development
10
order by the applicant for development approval; and

WHEREAS, the City Council has examined and investigated
32
the application and staff recommendations; and the attached Develop-
23
ment Review Status Sheet dated 3/9/84; and
14
WHEREAS, the City Council reviewed the revised development
13
order and accompanying documents at a public meeting; and
16
WHEREAS, the City Council has determined that the applica-
tion is in compliance with all elements of the'Comprehensive Plan, or
Y
will be in compliance prior to the issuance of a Certificate of
Occupancy for the development that is the subject of the application.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA:
SECTION 1: That the application for approval of a revised

site plan for Ashmont/Kings Point, prepared by F & R Builders, Inc.,

revised March 2, 1984, to reflect 'As -Built' guardhouse, mailboxes,
24
shuffleboard court shades, change F4 to one bedroom unit, change
23
handicap space to regular spaces (1 handicapped space per condo
26
association) and redistribute parking at Building E, is approved
27
subject to the following conditions:
A. Construction is to be in complete compliance with the
9
plans and specifications submitted by the developer to the City of
Tamarac as described in Section II of the Development Review Status
32 Sheet and approved engineering drawings.
33 B. Commencement of construction shall be no longer than
one year from the date of this approval. If the development does not
34
33 commence construction within one year, this approval is null and void
36 unless an extension has been granted in accordance with applicable
regulations.

C. The revised development order is,assignable, but an
assignment does not discharge any assignee from strict compliance wi
the order unless the City Council consents to modify any of the
original requirements.
D. Additional conditions established in order to issue
the revised development order are set forth as follows:

SECTION 2: Should any section or provision of this revisec
development order be declared by a court of competent jurisdiction to
be invalid, the City Council shall determine if the other portions of
the order remain valid or whether the approval shall be null and void.
SECTION 3: This revised development order as conditioned
shall become effective immediately upon adoption.
