R-84-� A RESOLUTION APPROVING AND ACCEPTING A DECLARATION OF PROTECTIVE COVENANTS AND RESTRICTIONS OFFERED BY LAKES OF CARRIAGE HILLS, INC.; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Declaration of Protective Covenants and Restrictions offered by Lakes of Carriage Hills, Inc., is hereby approved and accepted, a copy of which is attached hereto as Exhibit A. SECTION 2: That the appropriate City officials are hereby authorized to execute said document on behalf of the City. SECTION 3: That the City Clerk is hereby authorized and directed to record said document in the public records of Broward County, Florida. W I T N E S S E T H: WHEREAS, Lakes is the owner in fee simple of the real pro- perty described on Exhibit "A" annexed hereto and made a hart hereof (the "Property") and Lakes intends to develop the Property with commercial improvements; and WHEREAS, Lakes is developing a condominium project contiguous to the Property and currently operates a model and sales and administrative offices ("Sales Office") located on that southern portion of the Property described on Exhibit "B" annexed hereto and made a part hereof ("Parcel B") and Lakes desires to construct a temporary roadway to provide access to the Sales Office, a copy of the site plan for said temporary roadway being attached hereto and made a part hereof as Exhibit "F"; and WHEREAS, Lakes desires to commit the Property to the provi- sions of this Declaration. NOW, THEREFORE, in consideration of the premises and covenants herein contained, Lakes hereby declares that the Property shall be owned, held, used, transferred, sold, conveyed, demised and occupied subject to the covenants, restrictions, provisions and burdens hereinafter set forth. 1. Protective Covenants and Restrictions: Lakes does hereby declare that the following provisions shall be applicable to the Property which shall be transferred, demised, sold, con- veyed and occupied subject to the terms of this Declaration as follows: A. The following uses shall be prohibited on that portion of the Property described on Exhibit "C" annexed hereto and made a part hereof ("Parcel C"): (i) ambulance services; L (ii) indoor amusement centers; (iii) auto repair service and paint and body shops; (iv) selling or distribution of bait fish (other than artificial); (v) retail bird stores; (vi) outside storage of bottled gas; (vii) broadcasting studios and broad- casting towers; (viii) day care nurseries; (.ix) exterminator establishments; (x) retail fish markets; (.xi) sales of fishing supplies and bait tackle; (,xii)_ funeral homes; (xiii) furriers; (xiv) ice distributing depots; (xv) landscape nurseries; (xvi) launderettes; (xvii) lawn maintenance services; (xviii) soft drink stands; (xix) shops, storage and service establishments dealing in sprinkler systems; (.xx) retail tropi- cal fish shops; (xxi) video sales and exchange clubs; (xxii) fast food service establishments with drive-thru facilities; (.xxiii) food outlets (wholesale); (xxiv) food processing plants; and (xxv) cocktail lounges. B. The following uses shall be prohibited on Parcel B: (i) all of the prohibited uses set forth in Section 1.A hereof; Cii) retailing and wholesaling auto parts and equipment and auto accessories; (iii) auto tag agencies and license bureaus; (:iv) bicycle stores and repair shops; (v) carry out food establish- ments; Cvi)_ dry cleaning establishments with on -premises cleaning; (vii) freight service establishments; (viii) retail fruit stores; (-ix) retail garden supplies stores; (:x) retail heating equipment; (xi) key shops; (xii), laundry establishments (with on -premises washing); Ccii). lawn mower sales and repairs; (xiv) retail sales of millwork.; (xv). outdoor (:sidewalk) sales; and (xvi) restaurants and dining rooms. However retail food service establishments (-for example, coffee shop, etc.). shall be permitted within an office building. C. Grocery convenience stores with less than four thousand C4,00.01 square feet of gross floor area shall be pro- hibited on the Property. This paragraph C does not apply to 2 e delicatessens, ethnic, or other similar specialty grocery stores. D. The prohibitions and restrictions set forth in Paragraphs A, B, and C of this Section 1 shall be deemed cove- nants running with and binding upon the respective portions of the Property described in such Paragraphs. 2. Residential Wall and Landscaped Buffer: Lakes acknow- ledges that the eastern boundary of the Property abuts a resi- dentially zoned district and, accordingly, Section 28-140.(e) of the Code of the City of Tamarac (the "Code") provides that a six foot W) high solid masonry wall and a ten foot (101) landscaped buffer strip on the interior side of such wall is required to be constructed at such time as the Property is improved. Lakes covenants and agrees that, upon the construction of building improvements on Parcel B (other than the Sales Office), Parcel C and/or Parcel D, Lakes shall cause to be constructed upon such portion of the Property then being improved, a wall in accordance with the requirements of Section 28-140.(e) of the Code and a ten foot (.10') landscaped buffer strip on the exterior side of such wall rather than on the interior side as set forth in the Code. The obligation of Lakes described herein to construct the wall and landscaping of an exterior buffer is subject to Lakes obtain- ing approval from the City of Tamarac ("City"), as may be necessary. Lakes agrees that the wall shall be completed upon Parcel B, Parcel C and/or Parcel D within thirty (30) days after issuance of a building permit for the building improvements upon the particular parcel by the City. For example, within thirty (30) days after issuance of a building permit for building improvements on Parcel B, the wall herein described will be completed upon Parcel B. Furthermore, Lakes agrees to grant, on its plat of the Property, to the Gardens of Sabal Palms Condominium Association, Inc. ("Gardens Association") an easement for ingress and egress 3 in order to enable the Gardens Association to maintain the ten foot (101) landscaped strip and Lakes covenants and agrees, at Lakes expense, to install a sprinkler system to water said ten foot (10') strip which system will tie into the Gardens Associa- tion's existing sprinkler system. 3. Conveyance of Land to Gardens Association: Lakes shall convey to the Gardens Association by quitclaim deed, subject to the terms of this Agreement, the property described in Exhibit "E" attached hereto and made a part hereof ("Parcel E"). Parcel E is zoned S-1 under the Code and shall be maintained as a land- scaped buffer by the Gardens Association under the S-1 zoning. 4. Sales Office Temporary Driveway: Lakes shall have the right to construct a temporary driveway from the Sales Office to Sabal Palm Boulevard, which driveway shall be twenty-four (24) feet wide to encompass two lanes of vehicular traffic (the "Driveway"), as indicated on Exhibit "F". Lakes agrees that the Driveway shall be removed and resodded on the earlier to occur of (a) thirty (30) months from the date hereof or (b) upon the removal of the Sales Office from Parcel B. Lakes covenants and agrees that the Sales Office shall be removed from Parcel B prior to Lakes obtaining permits to construct commercial buildings thereon and Lakes agrees that no access to Sabal Palm Boulevard shall be constructed subsequent to the removal of the Driveway. 5. Further Improvements on South Parcel: Lakes covenants and agrees that, upon the issuance of a certificate of occupancy for any new building improvement constructed upon Parcel B (other than the Sales Office), Parcel E shall be landscaped and no improvements shall thereafter be constructed thereon. Furthermore, within sixty (60) days after the issuance of a building permit for any new building improvement to be constructed upon Parcel B (other than the Sales Office), Lakes shall cause to be constructed along the southern boundary of Parcel B a three foot (3') high berm consisting of clean fill. Sod and sprinklers shall be installed at the time of construction of the berm, and landscap- 4 ing shall be installed before the issuance of a certificate of occupancy. 6. Graphic Depiction of Parcels: A graphic depiction of the relationship and location of the Property and the various Parcels referred to herein, is attached hereto and made a part hereof as Exhibit "G". 7. Captions, Headings and Titles: Section and paragraph captions, headings and titles inserted throughout this Declara- tion are intended as a matter of convenience only and in no way shall such captions, headings or titles define, limit or affect the subject matter or any of the terms and provisions thereunder. 8. Severability: In the event any of the provisions of this Declaration shall be deemed invalid by a court of competent jurisdiction, said judicial determination shall in no way affect any of the other provisions hereof, but shall remain in full force and effect. Any provision of this Declaration deemed invalid by a court of competent jurisdiction by virtue of the term or scope thereof shall be deemed limited to the maximum term and scope permitted by law. 9. Governing Law: This Declaration shall be construed and interpreted according to the laws of the State of Florida. The parties agree that the Master list of permitted uses as provided in Section 28-171 of the. Code, which may be amended from time to time, shall apply to development of the Property, except for the uses herein prohibited. 10. Modification: This Declaration shall not be modified (and no purported modification hereof shall be effective) unless agreed in writing and signed by the parties hereto or their successors and assigns. 11. Option Agreement: This Declaration does not affect or modify that certain Option Agreement dated February 1, 1982 by and between Lakes- and the City. 12. Not- withstanding the foregoing, in the event of any mail disruption by virtue of any stoppage of mail service performed by the United States Postal Service due to strike or labor difficulty, notice, requests or demands or other communications referred to in this Agreement shall be sent by telegraph, but shall be deemed to have been given when received. 13. Parking Requirements and F.P.L. Easement: The Property is encumbered by an easement in favor of Florida Power & Light Company ("F.P.L. Easement"). Based upon the letter from Florida Power & Light Company attached hereto and made a part hereof as Exhibit "H", the City hereby approves the placement by Lakes on the F.P.L Easement the parking spaces required to be constructed on the property pursuant to the Code. Lakes agrees that the design of said parking spaces shall be in compliance with the Code. 14. Building Coverage: It is agreed that Lakes shall be entitled to building coverage on the Property equal to the build- ing coverage which would be allowed on the Property plus that which would be allowed in Parcel E if it were zoned B-1, subject to all the other requirements of the Code such as parking, land- scape and the like. 15. Successors and Assigns: This Declaration shall be binding upon Lakes, the City , and their successors and assigns. 11 1 1 0 16. Enforcement: The covenants and restrictions herein contained may be enforced by Lakes, the City, the Gardens Associa- tion and Village of Sabal Palms Condominium Association, Inc.
