CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
A RESOLUTION ADVOCAT1'NG THE ENACTMENT OF A
STATE STATUTE IMPLEMENTING A MINIMUM
MANDATORY WARRANTY FOR THE PURCHASE AND SALE
OF USED MOTOR VEHICLES IN THE STATE OF
FLORIDAR AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the purchase and sale of used motor vehicles is
an area where there is a need for consumer protection; and
WHEREAS, as there is no longer a state -required periodic
inspection of motor vehicles; and
WHEREAS, the high cost of motor vehicle insurance and
medical services resulting from the operation of unsafe motor
vehicles impacts all Floridians and visitors to Florida; and
WHEREAS, Florida Statute 672.316(3) as part of the
Uniform Commercial Code provides in general for "as is" sales
in commerce.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA.
SECTION l: That the Broward County Delegation of State
Legislators is urged to sponsor an amendment to the Florida
Statutes requiring that the sale of all motor vehicles have a
warranty against undisclosed defects for a period of 1,000
miles or thirty days from the time of delivery, whichever
comes first (unless a manufacturer's warranty is superior to
this requirement). Additionally this requirement should
control all purchases from businesses dealing in the sale of
motor vehicles. Should the Legislature deem it necessary to
provide for a waiver of this provision, a separate document
with specified language and size of print shall be executed
by the purchaser before the right to a warranty is waived.
SECTION 2: That the City Clerk is directed to send a
copy of this Resolution to the members of the Broward County
Delegation to the Florida Legislature as evidence of the
concern of the Tamarac -City Council on this subject.

SECTION 3:_ That this Resolution shall become effec-
tive immediately upon its passage.
