R-84-ya?_ 1 2 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO.. 01-6 FOR A REVISED SITE PLAN FOR 3 ASHMONT; AND PROVIDING AN EFFECTIVE DATE. 4 5 WHEREAS, pursuant to the instructions of the City Council of 1 6 Tamarac, Florida, a public meeting has been advertised in ac- 7 cordance with applicable law of the date, time and place of the 8 meeting regarding the review of the application for a revised 9 development order by the applicant for development approval; and 10 WHEREAS, the City Council has examined and investigated the 11 application and staff recommendations and the attached Development 12 Review Status Sheet dated 12/19/84; and 13 WHEREAS, the City Council reviewed the revised development 14 order and accompanying documents at a public meeting; and 15 WHEREAS; the City Council has determined that the application 16 is in compliance with all elements of the Comprehensive Plan, or 17 will be in compliance prior to the issuance of a Certificate of 18 Occupancy for the development that is the subject of the applica- 19 i tion. 20 NOW, THEREFORE,. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 21 TAMARAC, FLORIDA: 22 SECTION 1: That the application for approval of a revised 23 site plan for Ashmont, prepared by F & R Builders, Inc., revised 24 December 13, 1984, to reflect as -built setbacks and a fence 25 around the left station, is approved subject to the following 26 conditions: 27 A. Construction is to be in complete compliance with the 28 plans and specifications submitted by the developer to the City 29 of Tamarac as described in Section II of the Development Review i 30 Status Sheet and approved engineering drawings. 31 B. Commencement of construction shall be no longer than one ' 32 year from the date of this approval. If the development does not 33 commence construction within one year, this approval is null and 34 void unless an extension has been granted in accordance with applicable regulations. The revised development order is assignable, but an 2 assignment does not discharge any assignee from strict com- a pliance with the order- unless the City Council consents to 4 modify any of the original requirements.
