CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-84-�
A RESOLUTION PERTAINING TO DISPOSITION OF
TWO PERFORMANCE BONDS POSTED BY LENNAR
HOMES,•INC., FOR THE ASHMONT PHASE I
PROJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,Lennar Homes, Inc., as Principal, with the
Citibank, N.A., as Surety, has filed with the City Letter of
Credit No. NABG-R90446F in the amount of $18,272.00 to guarantee
paving and drainage and Letter of Credit No. NABG-904�$F in the
amount of $4,253.50. to guarantee landscaping associated with the
Ashmont Phase I project; and
WHEREAS, the bonds are due to expire and there is not properly
completed work; and
WHEREAS, the Principal has been notified that the work is not
properly completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1:
and correct.
That the recitations as set forth above are true
SECTION 2: That the appropriate City officials are hereby
authorized to call Letter of Credit:No. NAGB-90446F in the amount
of $18,272.00 posted to guarantee paving and drainage and Letter
of Credit No. NABG-9044yF in the amount of $4,253.50 to guarantee
landscaping associated with the Ashmont Phase I project if the
remedial _repairs are not completed on or before December 20, 1984,
or if the bonds have not been extended by that date.
SECTION 3: That said Letters of Credit be released if the
remedial repairs are accomplished on or before December 20, 1984,
subject to receipt of the following:

Payment of
additional. engineering fees
due
in the amount of
$566.50;
b)
A one-year
warranty bond .in the amount
of
$4,568.00 for
paving and
drainage;
c)
A one year
warranty bond in the amount
of
$7,921.25.
d)
A one-year
warranty bond in the amount
of
$1,063.38 for
landscaping.
SECTION 4: This Resolution shall become effective upon
adoption.
