A RESOLUTION PROVIDING FOR ACCEPTANCE OF A
HOLD HARMLESS AGREEMENT BETWEEN THE CITY OF
TAMARAC AND WOODMONT CORP., FOR A PORTION
OF THE UNRECORDED RIGHT-OF-WAY OF NORTHWEST
78TH AVENUE; AUTHORIZING THE PROPER CITY
OFFICIALS TO EXECUTE SAID AGREEM1ENT ON BEHALF
OF THE CITY OF TAMARAC; AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the certain Hold Harmless Agreement by and
between the City of Tamarac and Woodmont Corp. for a portion of the unrecorded
right-of-way of Northwest 78th Avenue is hereby approved. A copy of said
Agreement is attached hereto and made a part hereof.
SECTION 2: The appropriate City Officials are hereby
authorized and directed to execute said Agreement on behalf of the City of
Tamarac.
SECTION 3: This Resolution shall become effective immediately
upon its final passage.

Indemnification and Hold Harmless Agreement made this day of
198�, by and between WOODMONT OORP. here-
inafter referred to as "OWNER" and the CITY OF TAMARAC, a municipal
corporation in the State of Florida with offices at 5811 Northwest
88th Avenue, Tamarac, Florida, 33321, hereinafter referred to as "CITY".
W I T N E S S E T H:
WHEREAS, the "CITY" constructed a temporary school bus drive
in a proposed public right-of-way which will be Northwest 78th Avenue;

WHEREAS, it has cone to the attention of the "CITY" that the
dedication of Northwest 78th Avenue has yet to be completed by recorda-
tion of the plat for Block 30.
1) The "CITY" agrees to indemnify and hold harmless the
"OWNS ' WOODMONT CORP. from any and all liability which may arise from
the construction and use of the temporary bus drive running from North-
west 78th Street in a Southerly direction across the Westerly portion
of Woodmont Block 30 to the Elementary School.
2) This Agreement shall terminate automatically upon the
filing of the plat for Block 30 which recording effectuates the dedica-
tion of Northwest 78th Avenue.
IN WITNESS WHEREOF, the parties have hereunto set their
hands and seals on the day and yeEr first above written.
