R-84-3,p7 A RESOLUTION: URGING THE BROWARD COUNTY LEAGUE OF CITIES TO DEVELOP A SOLID WASTE DISPOSAL AND RECOVERY SYSTEM AS AN ALTERNATIVE TO THE PLAN BEING DEVELOPED BY BROWARD COUNTY AP,D PROVIDING THAT REPRESENTATIVES OF THE PARTICI- PATING MUNICIPALITIES IN THE LEAGUE OF CITIES BE INCLUDED IN THE MEMBERSHIP OF THE GOVERNING AUTIAORITY OF THE PROJECT AND FACILITIES TO BE ULTIMATELY CONSTRUCTED; AND PROVIDING AN EFFEC- TIVE DATE. WHEREAS, disposal of municipal solid waste within Broward County is a matter of great municipal concern; and WHEREAS, Article VIII, Section 2(b), of the Florida Constitution of 1968 and Section. 166.011, Florida Statutes, provide that municipal- ities shall have governmental, corporate and proprietary powers to enable them to conduct municipal government, perform municipal func- tions and render municipal services and may exercise any power for municipal services except as otherwise provided by law; and WHEREAS, the Broward County League of Cities should explore alternative technologies, methods of control and financing vehicles for the development of alternative resource recovery facilities for Broward County cities; and WJ77LEREAS, any facilities that are ultimately constructed for the unincorporated and incorporated areas of Broward County should be controlled by a board or authority consisting of representatives of both unincorporated and'incorporated.areas of Broward County. NOW, THEREFORE, ;E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA; SECTION 1: That the City Council of Tamarac hereby urges the Broward County.League of Cities to develop a solid waste disposal and recovery program as an alternative to the plan being developed by Broward County, Florida. SECTION 2: That such municipal alternative solid waste disposal Z and recovery program should provide and include: 3 a) Input on the progress of the froward County resource 4 recovery project. 5 b) Development of an alternative resource recovery contin- gency program for the members of the Broward County League of Cities by having reviewed alternate technolo- gies, financing, site selection, authority for t::e con- } trol of the resource recovery facilities fees for the usage of such facilities, monitor legislation as it 31 affects the County and municipalities resources recovery 32 plans. _ 33 c) The creation of a project management team to develop a 24 municipal solid waste alternative to the Broward County 1s resource recovery plan. 'J_° d) Such other components deemed appropriate by the Board ky of Directors of the Droward County League of Cities. SECTION 3: That any such solid waste disposal and recovery 4 29 program ultimately constructed for the incorporated areas and unincor- 20 porated areas of Broward County should be controlled by a governing Zi board consisting of representatives of both the participating munici- palities and representatives of the Board of County Commissioners of 23 Broward County, Florida. 34 SECTION 4: That the membership of the governing board of the 25 solid waste disposal and resource recovery project for the incorporate( 21� and unincorporated areas of Broward County be based upon the volume of 27 waste provided by the incorporated areas and unincorporated areas of 23 Broward County. SECTION 5: That the membership of such board or governing author- ity for the control and admini 31 stration of the solid waste disposal and recovery project for the incorporated and unincorporated areas of 32 Broward County be established by an interlocal agreement to be ap- 33 proved by each participating municipality and the Board of County Commissioners of Broward County, Florida. 35 36 I 2 SECTION 6: That the City Clerk is hereby directed to provide a copy of this Resolution to the Broward County League of Cities and each participating municipality.
