R-84-_�&D 4 5 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 136 FOR A REVISED SITE PLAN FOR BUD'S CARPET & TILE, INC.; AND PROVIDING AN EFFECTIVE DATE. 7 WHEREAS, pursuant to the instructions of the City Council of Tamarac, 8 Florida, a public meeting has been advertised in accordance with applicable law 9 of the date, time and place of the meeting regarding the review of the application 10 for a development order by the applicant for development approval; and 11 WHEREAS, the City Council has examined and investigated the application 12 and staff recommendations; and the attached Development Review Status Sheet dated 13 10/19/84; and 14 WHEREAS, the City Council reviewed the development order and accompanying 15 documents at a public meeting; and 16 WHEREAS, the City Council has determined that the application is in 17 compliance with all elements of the Comprehensive Plan, or will be in compliance 18 prior to the issuance of a Certificate of Occupancy for the development that is Na the subject of the application. 0 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 21 SECTION 1: That the application for approval of a revised site plan for 22 Bud's Carpet & Tile, Inc., revised October 15, 1984, to reflect location of a 23 ground sign, is approved subject to the following conditions: 24 A. Construction is to be in complete compliance with the plans and 25 specifications submitted by the developer to the City of Tamarac as described in 26 Section II of the Development Review Status Sheet. 27 B. Commencement of construction shall be no longer than one year from 28 the date of this approval. If the development does not commence construction 29 within one year, this approval is null and void unless an extension has been 30 granted in accordance with applicable regulations. 1 C. Additional conditions established in order to issue the development order are set forth as follows: 1 - Planter is provided around the sign and installation of landscaping per Beautification Committee. 2 - Applicant to meet with the City Planner to upgrade landscaping along State Road 7. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this ay of 1984.
