R-84- A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 137 FOR A REVISED SITE PLAN FOR FAMILY SEVEN GROCERY STORE, 1503 NW 44TH STREET (PROSPECT ROAD); AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application and staff recommendations; and the attached Development Review Status Sheet dated 10/19/84; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Family Seven Grocery Store, prepared by Penn Sign Service, Inc., dated August 21, 1984, to reflect location of a ground sign, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. Additional conditions established in order to issue the development order are set forth as follows: 1 - Applicant to submit new landscape plan to Beautification Committee indicating the parking lot reconstruction per City Code. 2 - Site Plan does not become effective until the applicant has received a permit to reconstruct the parking lot or posted an appropriate bond with completion guaranteed within one year. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this ✓� day of� 1984.
