R-84-=?� A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 087-2 FOR A REVISED SITE PLAN FOR THE CONCORD VILLAGE II PROJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations; and the attached Development Review Status Sheet dated 10/19/84; and WHEREAS, the City Council reviewed the revised development order and accompanying docents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TIC CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Concord Village II, revised October 17, 1984, to reflect the following changes: (1) Waiver of the 20-foot berm along NW 88th Avenue; and (2) Reducing three buildings from three stories to one story on the south side of NW 61st Street, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Comiencement of construction shall be no longer than one year from June 17, 1984. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The revised development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. i 1 2 3 4 8 9 f3 9 20 23 24 25 26 �tw 1 33 34 Temp. #3344 D. Additional conditions established in order to issue the revised development order are set forth as follows: 1 - All previous requirements by Council must be included on site plan. 2 - Council to consider granting waiver to allow 15' berm and 3' wall on NW 88 Avenue, in lieu of the required 20' berm. 3 - Provide "Right Turn Only" signs on NW 88 Avenue. 4 - Provide easement for sidewalk along NW 84 Terrace prior to issuance of building permit. 5 - By typical note, indicate that all driveways have 47' turning radius. 6 - Dumpsters to comply with code. 7 - Prior to building permit issuance, applicant should submit a revised landscape plan to the Beautification Committee for approval. 8 - The transfer of Water/Sewer Agreement with a new graphic sketch of reduced site plan attached shall be provided prior to issuance of any- building permits. 9 - Developer has agreed to post with the City a Letter of Credit in the amount of $25,000.00 for two or three years time for a traffic light at NW 61 Street if the County approves and it is deemed necessary. 10 - Developer has agreed to pay an additional $15,000.00 for Parks and Recreation fees before building permits are issued. SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this �I` day of , 1984.
