R-84-3 3 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 091-2 FOR A REVISED SITE PLAN FOR TAMARAC MARKET PLACE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations; and the attached Development Review Status Sheet dated 10/18/84; and WHEREAS, the City Council reviewed the revised development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Tamarac Market Place, prepared by Randall F. Keller, AIA, revised September 20, 1984, to reflect addition of Chicken Unlimited and relocation of a ground sign, from the northeast corner of the plaza to the central entrance drive, is approved subject to the followina conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. Additional conditions established in order to issue the revised development order are set forth as follows: 1 - Handicap parking spaces to be in conformance with South Florida Building Code. 2 - No call box (order station) permitted. 3 - All prior comments pertaining to this development still being valid. SECTION 2: Should any section or provision of the revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage.
