R-84- A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 141 FOR A REVISED SITE PLAN FOR BROOKWOOD PLAZA; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application and staff recommendations; and the attached Development Review Status Sheet dated 10/19/84; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Brookwood Plaza, revised October 3, 1984, to reflect a temporary drive, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. Additional conditions established in order to issue the development order are set forth as follows: 1. The existing center must be landscaped in accordance with today's standards at the time of construction of the temporary drive. 2. Fire Department recommends all landscaping to be a minimum of 9' from the access road turning areas and a minimum of 6' from hydrants. 3. Before an engineering permit is issued for the roadway, the applicant must provide a cost estimate. 4. In all areas within 10' of the paved roadway, there shall be at least 132 feet of vertical clearance to allow for the overhang of the aerial ladder to insure a clear turning radius for fire department vehicles. 5. Place addresses and tenant names on all rear doors for identification for Fire Department purposes. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this day of 1984.
