A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA
AUTHORIZING THE EXECUTION OF OPTIONS TO
PURCHASE 40 ACRES, MORE OR LESS, OF LAND FOR
HOLDING PONDS; AND PROVIDING AN EFFECTIVE
DATE.
VMERE'.AS, it is necessary to secure options to purchase 40.
acres of land for holding areas for treated wastewater as part of the City's
wastewater disposal system; and
WHEREAS, it is in the best interest of the health, safety and
welfare of the citizens of Tamarac to secure such options at the earliest
possible time and within Land Section 7.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That options by executed by the appropriate City
officials to secure 40 acres of land in Land Section 7 for holding areas.
SECTION 2: Copies of the proposed options are attached hereto
and made a part of.
SECTION 3: That this Resolution shall become effective
immediately upon its passage.

OPTION TO BUY
The City of Tamarac, a municipal corporation, with offices at 5811
Northwest 88th Avenue, Tamarac, Florida, 33321, hereinafter called the
"Buyer" and Richard C. Jones, Trustee, hereinafter called the "Seller"
hereby agree that the "Seller" shall sell and the "Buyer" shall buy
the following described property upon the terms and conditions herein-
after set forth.
1. The "Seller" hereby grants to the "Buyer" the option to purchase
a 40 acre, plus or minus, tract of land, a sketch and drawing of
which are attached hereto as Exhibit "A".
2. The "Buyer" shall have the right to exercise the option on or before
October 1, 1985.
3. The option may be exercised by sending written notice to:

North Miami, Florida 33161
4. The purchase price shall be at the rate of $20,800.00 per acre.
5. "Buyer" and "Seller" agree that this purchase price is only effective
until the "Seller" receives a good faith offer to purchase the
subject property at a purchase price which exceeds that set forth in
Paragraph 4 above. If during the term of this option, such good
faith offer to purchase is received by the "Seller", the "Buyer"
shall have the right of first refusal to purchase the property at
the same price offered the "Seller". The "Buyer" shall have thirty
(30) days in which to decide whether to exercise this right of first
refusal.
6. The consideration for the grant of this option is the purchase of
the 40 acre parcel currently used as a sod farm by the City for the
sum of $832,500.00.

DESCRIPTION
A parcel of land in Tracts 17, 18, 23 and 24 of Section 7, Township 49 South,
Range 41 East of the FLORIDA FRUITLANDS COMPANY SUBDIVISION NO. 2 as recorded
in Plat Book 1, Page 102 of the Public Records of Palm Beach County, Florida,
being more particularly described as follows -
COMMENCE at the Northwest corner of the Southwest One -Quarter (SW 1/4) of said
Section 7, said point having a Florida State Plane Coordinate of N 679182.74
and E 730244.51 (East Zone);
THENCE on a grid bearing of N 89°19'54" E along the North line of the said
Southwest One -Quarter (SW 1/4) a distance of 638.74 feet to a point on the arc
of a non -tangent curve concave to the East, a radial line of said curve
through said point having a bearing of S 80°13'37" W, said curve also being
the East right-of-way line of Sawgrass Expressway;
THENCE Southerly along the arc of said curve to the left, having a central
angle of 00°06'58" and a radius of 7501.15 feet for an arc distance of 15.19
feet to the POINT OF BEGINNING;
THENCE continue Southerly along said Easterly right-of-way line, along the arc
of said curve to the left, having a central angle of 07°54'32" and a radius of
7501.15 feet for an arc distance of 1035.43 feet to a Point of Tangency;
THENCE S 17°47'38" E along said Easterly right-of-way line, along a line
tangent to the last described curve a distance of 286.96 feet to a line 29.26
feet North of and parallel with the South line of said Tracts 18 and 23;
THENCE N 89013'24" E along said parallel line a distance of 1183.69 feet to
the East line of said Tract 18;
