A RESOLUTION APPROVING AND AUTHORIZING EXECU-
TION OF AN ENGINEERING AGREEMENT WITH
VILLAS AT WOODMONT 73, A CONDOMINIUM ASSO-
CIATION: A D PROVIDING AN EFFE T_-,yE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAM-
ARAC, FLORIDA.
S 921-0N 1: That the Engineering Agreement with
Villas at Woodmont 731 a condominium association, for the
City to alleviate flooding problems by regrading the
driveways of certain residences located within Woodmont Tract
73 is hereby approved, a copy of which is attached as
Exhibit A.
SECTION: That the appropriate City officials are
hereby authorized to execute said agreement on behalf of the
City.
SECTIO_ N _1: This Resolution shall become effective
immediately upon adoption.

AGREEMENT
THIS AGREEMENT, made and entered into this 26th day of
September, 1984, by and between:
CITY OF TAMARAC, a municipal corporation of
Florida, hereinafter referred to as "CITY"; and
VILLAS AT WOODMONT 73, a condominium association,
hereinafter referred to as "ASSOCIATION".
WHEREAS, certain homeowners of the ASSOCIATION are ex-
periencing flooding problems in the swale area of their
driveways; and
WHEREAS, the CITY desires, for the mutual benefit of
both parties, to alleviate the drainage problem by entering
into this engineering agreement with the ASSOCIATION.
WHEREAS, pursuant to Resolution 84-295, adopted on
September 26, 1984, the proper CITY officials were authorized
and directed to execute this agreement;
NOW, THEREFORE, in consideration of the mutual covenants
and undertakings of the parties hereto and other good and
valuable considerations, the parties hereto covenant and
agree each with the other as follows:
(1) The CITY will provide all labor and equipment for
the regrading of the swale area of the driveways according to
the specifications described in the attached Exhibit A, for
the following 50 residences located within Woodmont Tract 73:

8073, 8091, 8097, 8098

8097, 8098, 8081, 8071, 8055, 8041, 8050, 8002,

(2) The work is to be done in two phases--(1) driveway
repair and (2) sealcoating. The Association will pay the
cost of materials only, not to exceed $10,000 for the repair
phase. The Association will pay the cost of labor and
materials not to exceed $2,000 for the sealcoating phase of
all 70 driveways. At the City's discretion, the sealcoating
may be subcontracted to a third party, or the City will
assist the Association with the selection of a sealcoating
contractor. The repair phase will be completed before
January 1, 1985. The surface needs to weather before it is

sealcoated. The seal coat will be completed by April 1,
1985. Payment will be made for the driveway repair within 30
days after invoicing from the City. Payment for sealcoating
will be due upon completion of the work unless otherwise
agreed before the work begins.
(3) The ASSOCIATION agrees to waive all and any war-
ranties, expressed or implied, as to the CITY's performance
under this Agreement. The ASSOCIATION further .agrees_to_hold
harmless the CITY for any consequential damage to persons or
property resulting from any inadequate or negligent perfor-
mance by the CITY under this Agreement.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed on the day and year first hereinabove
written.
