A RESOLUTION ESTABLISHING AND MODIFYING RATES AND
CHARGES APPLICABLE TO THE UTILITY OWNED BY THE CITY
OF TAMARAC SERVING CUSTOMERS EAST OF STATE ROAD 7;
,&ND PRMDING AN_ EFFECTIVE_ DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTIOA.1. The Rate Schedule set forth below shall be
applicable to all customers of the water and sewer utility
served by the City of Tamarac for customers east of State
Road 7.

The number of ERC's for multi -family residential

on the following formula:

receiving service shall, in addition to the rates set,

Facility, the following criteria shall apply:

2 Membership in the Homeowner;' Association which controls
and operates the common facilities is required as a
3 condition of property ownership in the subdivision; and
such requirement arises from restrictions of record
4 which are set out or incorporated by reference on each
member homeowner's deed.

Such restrictions require each member homeowner to pay
6 his proportionate share of the costs of operating and
maintaining the common facilities. This obligation to
7 pay must be enforceable by placement of a lien on the
member homeowner's property and by foreclosure for non-
8 payment of such liens.
9 The Homeowners Associations are comprised of persons
owning contiguous lots in a planned development, and the
10 commonly owned facilities are located within the
development.
