NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTIOA.1. Customers outside of the corporate limits of the City receiving service shall, in addition to the rates set, 17 pay a surcharge of 25%. 18 P. Service availability charges shall be prorated for customers becoming a part of or leaving the system ga during a billing cycle. o Q. To qualify as a Homeowner Association Recreational Facility, the following criteria shall apply: 21 CONDOIrJIN?tlM ATvl CUUP YES: 22 100% of the water and sewer is used exclusively for the 23 co -owner's benefit. 24 None of the water and sewer is used in any endeavor which sells or rents a. commodity or provides a service 25 for a fee. 26 Each point of service is separately metered and billed. 27 A responsible legal entity is established as the cus- tomer to whom the Utility can render its bills, and 28 receive payment for said service. 299.kiS�-AG13-0s 30 100% of the water and sewer is used exclusively for the member homeowners' benefit. l None of the water and sewer is used in any endeavor 2 which sells or rents a commondity or provides a service for a fee. 33 Each point of service is separately metered and billed. 34 A responsible legal entity is established as the cus- 35 tomer to whom the Utility can render its bills, and receive payment for said service. 36 3 l 2 Membership in the Homeowner;' Association which controls and operates the common facilities is required as a 3 condition of property ownership in the subdivision; and such requirement arises from restrictions of record 4 which are set out or incorporated by reference on each member homeowner's deed. 5 Such restrictions require each member homeowner to pay 6 his proportionate share of the costs of operating and maintaining the common facilities.
