3 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER
NO. 021-13 FOR REVISED SITE PLAN #5 FOR WOODMONT
4 TRACT 74/75; AND PROVIDING AN EFFECTIVE DATE.
5 WHEREAS, pursuant to the instructions of the City Council
6 of Tamarac, Florida, a public meeting has been advertised in accord-
7 ance with applicable law of the date, time and place of the meeting
8 regarding the review of the application for a revised development
9 order by the applicant for development approval; and
10 WHEREAS, the City Council has examined and investigated
11 the application, staff and Planning Commission recommendations; and
12 the attached Development Review Status Sheet dated 7/20/84; and
13 WHEREAS, the City Council reviewed the revised development
14 order and accompanying documents at a public meeting; and
15 WHEREAS, the City Council has determined that the applica-
16 tion is in compliance with all elements of the Comprehensive Plan,
17 or will be in compliance prior to the issuance of a Certificate of
18 Occupancy for the development that is the subject of the application.
19 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TAMARAC, FLORIDA:
20 SECTION 1: That the application for approval of a Revised
21 Site Plan #5 for Woodmont Tract 74/75, revised July 3, 1984, to
expand the size of the units and reduce the number of units from 29
to 26, is approved subject to the following conditions:
24 A. Construction is to be in complete compliance with the
25 plans and specifications submitted by the developer to the City of
26 Tamarac as described in Section II of the Development Review Status
27 Sheet and approved engineering drawings.
28 B. Commencement of construction shall be no longer than
29 one year from the date of this approval. If the development does not
30 commence construction within one year, this approval is null and void
31 unless an extension has been granted in accordance with applicable
32 regulations.

1 C. The revised development order is assignable, but an
2 assignment does not discharge any assignee from strict compliance
3 with the order unless the City Council consents to modify any of
4 the original requirements.
5 D. Additional conditions established in order to issue the
6 revised development order are set forth as follows:
7 1 - Submission of legal proof that the owner of the.
adjacent parcel of land guarantees their -building will
8 be no closer than 20-feet away from Building P-II to
avoid potential need for variances in the future
9 (see attached letter from James Maley, Assistant Vice
President, Montwood, Inc., dated July 3, 1984).

11 SECTION 2: Should any section or provision of this revised
12 development order be declared by a court of competent jurisdiction
13 to be invalid, the City Council shall determine if the other portions
14 of the order remain valid or whether the approval shall be null and
15 void.
16 SECTION 3: This revised development order as conditioned
17 shall become effective immediately upon its passage.
