P11-2-.5' A RESOLUTION EXPRESSING THE INTENT OF THE CITY OF TAMARAC, FLORIDA7 TO ISSUE WATER AND SEWER UTILITY REVENUE BONDS OF THE CITY IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $15,000,000 TO PAY THE COSTS OF CERTAIN CAPITAL IMPROVEMENTS FOR TAMARAC UTILITIES WEST, IF SUCH ISSUANCE IS APPROVED BY A MAJORITY OF THE QUALIFIED ELECTORS OF THE CITY RESIDING WEST OF STATE ROAD 7,. AUTHORIZING THE PLACEMENT OF SUCH ISSUE ON THE BALLOT TO BE USED IN THE MUNICIPAL ELECTION SCHEDULED FOR MARCH 13, 1984; PROVIDING THE METHOD AND MANNER FOR NOTICE OF SAID REFERENDUM; AND APPROVING THE FORM OF SAID BALLOT; WHEREAS, the City of Tamarac (the "City") under the authority granted by the Constitution and laws of the State of Florida, including its Home Rule Charter and Chapter 166, Florida Statutes, is authorized to issue water and sewer utility revenue bonds to provide funds to pay for the cost of capital improvements to the wastewater treatment system, which is owned and operated by the City of Tamarac Tamarac Utilities West; WHEREAS, the City has determined that certain capital improvements both on -site and off -site to the Tamarac Utilities West wastewater system are necessary to bring aforesaid system into compliance with federal, state, and local environmental regulations by the construction and expansion of the system and plant, the acquisition of land and equipment, and other related capital improvements (the "Project"); WHEREAS, the City intends to pay for the capital improvements by issuing its water and sewer utility revenue bonds in an aggregate principal not to exceed $15,000,000, which together with interest will be paid solely from the net revenues of Tamarac Utilities West, provided that a majority of the qualified electors residing west of State Road 7 approve the bond issue in the election scheduled for March 13, 1984; and 00I WHEREAS, it is necessary for the City Council to prescribe the method and manner of holding the election, to 1 2 provide for notice thereof, and to approve the form of ballot 3 to be utilized in the election. - 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF 5 THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council authorizes the 6 7 issuance of water and sewer utility bonds of the City of 8 Tamarac in an aggregate principal amount not to exceed 9 $15,000,000 to pay the costs of the Project for the purpose of bringing Tamarac Utilities West wastewater treatment system 10 into compliance with federal, state, and local environmental 11 regulations, provided, however, that a majority of the 12 13 qualified electors residing west of State Road 7 approve the 14 bond issue in the election scheduled for March 13, 1984. Payment of the bonds with interest will be solely from the net 15 16 revenues of Tamarac Utilities West. SECTION 2: That notice of the election will be 17 published in the Fort Lauderdale News and Sun Sentinel, 18 newspapers of general circulation, in the City of Tamarac, 19 Florida, at least twice prior to election week, once in the 20 fifth week which commences on Sunday, February 5th, and once in 21 the third week, which commences on Sunday, February 19th. The 22 date of the first publication in the week of February 5th shall 23 be at least thirty (30) days before the election. Notice shall 24 be substantially in the following form: 25 26 27 NOTICE OF SPECIAL ELECTION FOR ISSUANCE OF 28 WATER AND SEWER UTILTY REVENUE BONDS 29 r TO BE HELD ON .30 MARCH 13, 1984 31 CITY OF TAMARAC, FLORIDA 32 As provided by Resolution No. , duly passed and 33 34 -2- uu 1' 2 3 4 5 6 7 8 91 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 I 25 26 27 28 29 .30 31 2 33 34 adopted by the City Council of the City of Tamarac, Florida, on January 25, 1984, a special bond election will be held on TUESDAY, MARCH 13, 1984 for the purpose of submitting to the qualified electors of the City of Tamarac, Florida, residing west of State Road 7, the following question: Shall bonds of the City of Tamarac, Florida, in an aggregate principal amount not to exceed $15,000,000 be issued as may be needed to provide funds which together with other available funds, will be used to pay the cost of on -site and off -site capital improvements to bring Tamarac Utilities West wastewater treatment system into compliance with federal, state, and local environmental regulations by further construction and expansion of the wastewater treatment system and plant, the acquisition of land and equipment and other related capital improvements, such bonds to mature at such time(s) not exceeding forty (40) years from their date(s) as may be determined by the City Council, and to bear interest at rates not to exceed the maximum rate then permitted by law, and to be payable solely from the net revenues derived from the operation of Tamarac Utilities West? The polls at the election will be open from 7:00 o'clock A.M. until 7:00 o'clock P.M. of the same day. Marilyn Bertholf City Clerk SECTION 3: That said special bond election will be conducted by the election officers selected and appointed by the Broward County Supervisor of Elections and will be held at the same polling places in the several precincts, respectively, in the City as the polling places for regular City elections held pursuant to the Charter of the City of Tamarac. SECTION 4: That Marilyn Bertholf, City Clerk, is hereby designated and appointed as the official representative of the City Council in all transactions with the Supervisor of Elections of Broward County in relation to matters pertaining to the use of the registration books and the holding of said special bond election. SECTION 5: That the ballot used at the election for voting on the question submitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which shall contain a statement of the question submitted. FOR BONDS AGAINST BONDS SECTION 6: That electors desiring to vote for or against the issuance of the bonds shall punch the appropriate box on. the ballot card containing the words "FOR BONDS" or "AGAINST BONDS." SECTION 7: That ballots containing the question set forth in Section 5 above shall be prepared for the use of absent electors entitled to cast such ballots in the election.
