HomeMy WebLinkAboutCity of Tamarac Resolution R-84-024Temp. # 2979 Rev. 1/25/84 2nd Rev. 1/25/84 1 1 3 4 5 6 7 8 9 10 ,i 17 18 19 20 21 22 23 24 25 26 7 3 29 30 31 32 33 34 CITY OF TAMARAC, FLORIDA RESOLUTION NO. eq-Ail RESOLUTION EXPRESSING THE INTENT OF THE CITY OF TAMARAC, FLORIDA, TO ISSUE GENERAL OBLIGATION BONDS OF THE CITY IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $8,000,000 TO PAY THE COSTS OF CERTAIN CAPITAL IMPROVEMENTS, IF SUCH ISSUANCE IS APPROVED BY A MAJORITY OF THE QUALIFIED ELECTORS OF THE CITY; AUTHORIZING THE PLACEMENT OF SUCH ISSUE ON THE BALLOT TO BE USED IN THE MUNICIPAL ELECTION SCHEDULED FOR MARCH 13, 1984; PROVIDING THE METHOD AND MANNER FOR NOTICE OF SAID REFERENDUM; AND APPROVING THE FORM OF SAID BALLOT; WHEREAS, the City of Tamarac (the "City") under the authority granted by the Constitution and laws of the State of Florida, including its Home Rule Charter and Chapter 166, Florida Statutes, is authorized to issue general obligation bonds to provide funds to pay for the cost of capital improvements; WHEREAS, the City has determined that the planning, constructing, furnishing and equipping of a City Hall and Police Station are capital improvements which are necessary to provide the citizens of Tamarac with more efficient municipal and police services; WHEREAS, the City intends to pay for the capital improvements by issuing its general obligation bonds in an aggregate principal amount not to exceed $8,000,000, which together with interest will be a general obligation of the City payable from ad valorem taxes or any other legally available funds of the City, provided that a majority of the qualified electors approve the bond issue in the election scheduled for .March 13, 1984; and WHEREAS, it is necessary for the City Council to prescribe the method and manner of holding the election, to provide for notice thereof, and to approve the form of ballot to be utilized in the election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 001 I 8 9 10' 4 15 16 17 18 9 20 21 22 23 `2 4 25 26 29 30 31 32 33 34 SECTION 1: That the City Council authorizes the issuance of general obligation bonds of the City of Tamarac in an aggregate principal amount not to exceed $8,000,000 to pay the costs of planning, contructingl financing and equipping a City Hall and Police Station for the purpose of providing the citizens of Tamarac with more efficient municipal and police services provided, however, that a majority of the qualified electors approve the bond issue in the election scheduled for Mauch 13, 1984. Payment of the bonds with interest will be from ad valorem taxes or any other legally available funds of the City of Tamarac. SECTION 2: That notice of the election will be published in the Fort Lauderdale News and Sun Sentinel, newspapers of general circulation, in the City of Tamarac, Florida, at least twice prior to election week, once in the fifth week which commences on Sunday, February 5th, and once in the third week, which commences on Sunday, February 19th. The date of the first publication in the week of February 5th shall be at least thirty (30) days before the election. Notice shall be substantially in the following form: NOTICE OF SPECIAL ELECTION FOR ISSUANCE OF GENERAL OBLIGATION BONDS TO FINANCE A NEW CITY HALL AND POLICE STATION TO BE HELD ON MARCH 13, 1984 CITY OF TAMARAC, FLORIDA As provided by Resolution No. duly passed and adopted by the City Council of the City of Tamarac, Florida, on January 25, 1984, a special bond election will be held on TUESDAY, MARCH 13, 1984 for the purpose of submitting to the qualified electors of the City of Tamarac, Florida, the following question: -2- UU Shall bonds of the City of Tamarac, Florida, 1 in an aggregate principal amount not to exceed $8,000,000 be issued as may be needed 3 to provide capital improvement funds which 4 together with other available funds, will be 5 used for planning, constructing, furnishing 6 and equipping a new City Hall and a new 7 Police Station, such bonds to mature at such 8 time(s) not exceeding forty (40) years from 9 their date(s) as may be determined by the 10 City Council, and to bear interest at rates not to exceed the maximum rate then a permitted by law, and to be a general obligation of the City payable from ad 4 valorem taxes or any other legally available 15 funds of the City of Tamarac? 16 FOR BONDS 17 AGAINST BONDS 18 19 If the bond issue is approved, shall the 20 site for a City Hall and Police Station be: 21 SITE A 22 located on the west side of N.W. 88th Avenue in the 7500 block on a tract of land 24' consisting of 14.52 acres owned by the City 25 located just north of Tamarac Fire Station 26 which site would replace the Commercial 27 Boulevard site designated in the 1974 referendum? 29 OR 30 SITE B 31 Located on the tract of land consisting of 32 10.8 acres owned by the City on. the north 33 side of Commercial Boulevard between N.W. 34 IMM 001 3 4 5 6 7 8 9 10 t 14 15 ++ 16 1 1 17 18 19 20 21 23 24 I 25 26 29 30 31 32 33 34 88th Avenue on the West and N.W. 84th Terrace on the East? FOR SITE A FOR SITE B The polls at the election will be open from 7:00 o'clock A.M. until 7:00 o'clock P.M. of the same day. As provided by the City Charter, applicable City ordinances and State Statutes, the following polling places all located in the City of Tamarac, Florida are hereby designated for the special bond election which polling places may be changed by the Broward County Supervisor of Elections, as provided by law. The City of Tamarac shall be authorized to issue the bonds covered by the question set forth above when such issuance as set forth in the question has been approved by a vote of a majority of the qualified electors of the City of I Tamarac. Florida. By order of the City Council of the City of Tamarac, Marilyn Bertholf City Clerk SECTION 3: That the special bond election will be conducted by the election officers selected and appointed by the Broward County Supervisor of Elections and will be held at the same polling places in the several precincts, respectively, in the City as the polling places for regular City elections held pursuant to the Charter of the City of Tamarac. SECTION 4: That Marilyn Bertholf, City Clerk, is hereby designated and appointed as the official representative of the City Council in all transactions with the Supervisor of Elections of Broward County in relation to matters pertaining to the use of the registration books and the holding of special .bond election. SECTION 5: That the ballot used at the election for voting on the question submitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which shall contain a statement of the question submitted. MV SITE B Located on the tract of land consisting of 10.8 acres owned by the City on the north side of Commercial Boulevard between N.W. 88th Avenue on the West and N.W. 84th Terrace on the East? FOR SITE A FOR SITE B SECTION 6: That electors desiring to vote for or against the issuance of the bonds shall punch the appropriate box on the ballot card containing the words "FOR BONDS" or "AGAINST BONDS." Electors desiring to vote for Site A or Site B shall punch the appropriate box on the ballot card containing the words "FOR SITE A" or "FOR SITE B." SECTION 7: That ballots containing the question set forth in Section 5 above shall be prepared for the use of absent electors entitled to cast such ballots in the election.
