Reso. #3245 CITY OF TAMARAC RESOLUTION NO. R-84-a.3 A RESOLUTION APPROVING AND ACCEPTING A WATER RETENTION DEDICATION AGREEMENT OFFERED BY GEORGE J. KONTOGIANNIS, AS TRUSTEE FOR THE TAMARAC POINTE PROJECT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Water Retention Dedication Agreement offered by George J. Kontogiannis, as Trustee for the Tamarac Pointe project, is hereby approved and accepted, a copy of said agreement is attached hereto as Exhibit A. SECTION 2: That the appropriate City officials are hereby authorized to execute said agreement on behalf of the City. SECTION 3: That the City Clerk is hereby directed to record said agreement in the public records of Broward County, Florida. SECTION 4: This Resolution shall become effective upon adoption. KONTOGIANNIS, AS TRUSTEE, 380 South Fif h S reet, Suite 1, Columbus, Ohio, 43215 (Grantor) and the CITY OF TAMARAC, a Flo da municipal corporation having an address at 5811 Northwest 88th Avenue, Tam rac, Florida, 33321, (Grantee). (Whenever used herein, the term "Grantor" and "Grantee" shall include the respective successors and assigns of the parties hereto, whenever the context so admits or requires). WITNESSETH: WHEREAS, Grantor is the owner of that certain real property located in Broward County, more particularly described as: Parcel "A" of "The Mainlands of Tamarac Lakes, Unit Fifteen", according to the plat thereof recorded at Plat Book 71, Page 3 of the Public Records of Broward County, Florida. and as depicted upon Exhibit A attached hereto and made a part hereof, (hereinafter referred to as "Development; and WHEREAS, the Grantee has enacted Ordinance No. 79-47, as amended, which requires on -site water retention for drainage purposes in the approximate amount of five percent (5y) of the area to be developed, and WHEREAS, Grantor is desirous of dedicating certain properties in connection with the Development and in accordance with Ordinance No. 79-47, as amended, to provide for on -site water retention for drainage purposes. NOW, THEREFORE, in consideration of the mutual covenants and benefits to be derived hereunder, the Grantor hereby dedicates to the Grantee that certain property described as: A portion of Parcel"A" of the plat of "The Mainlands of Tamarac Lakes Unit Fifteen", as recorded in Plat Book 71, Page 3 of the Public Records of Broward County, Florida, being more particularly described as follows: Commencing at the northeast (NE) corner of said Parcel "A"; thence N. 89°02'49" W. along the north line of said Parcel "A", a distance of 265.10 feet to the point of beginning of this description; thence continue N. 89°02'49" W. along said north line a distance of 445.00 feet to the northwest (NW) corner of said Parcel "A"; thence S. 00*00116" E. along the west line of said Parcel "A", a distance of 1042.66 feet to a point of curvature of a circular curve to the right, having an initial tangent bearing of N. 00°00'16" W.; thence northeasterly along the arc of said curve, having a radius of 244.25 feet and a central angle of 35°15'23", a distance of 150.30 feet to the point of reverse curvature of a circular curve to the left; thence easterly and northerly along the arc of said curve, having a radius of 410.00 feet and a central angle of 35°15'23", a distance of 252.29 feet to the point of tangency; thence N. 00000'16" W., a distance of 512.14 feet to the point of curvature of a circular curve to the right; thence northerly and easterly along the are of said curve, having a radius of 50.00 feet and a central angle of 90°57'27", a distance of 79.38 feet to the point of tangency; thence S. 89°02'49" E., a distance of 272.47 feet; thence N. 00°57'11" E., a distance of 100.00 feet to the point of beginning. Said lands situate, lying and being in Broward County, Florida, and containing 3.154 acres, more or less, as depicted upon Exhibit B, attached hereto and made a part hereof, to have and to hold the same for on -site water retention for drainage purposes in connection with the Development. In the event that the property dedicated hereby is not used for on -site water retention for drainage purposes, this dedication shall be deemed null and void, and title to same shall revert to the Grantor herein.
