Reso. #3243 CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-84-eZ3,15 A RESOLUTION APPROVING AND ACCEPTING A ROADWAY DEDICATION AGREEMENT FOR A PORTION OF NW 70 AVENUE OFFERED BY GEORGE J. KONTOGTANNIS, AS TRUSTEE FOR THE TAMARAC POINTE PROJECT: AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Roadway Dedication Agreement for a portion of NW 70 Avenue offered by George J. Kontogiannis, as Trustee for the Tamarac Pointe project, is hereby approved, a copy of said agreement is attached hereto as Exhibit A. SECTION 2: That the appropriate City officials are hereby authorized to execute said agreement on behalf of the City. SECTION 3: That the City Clerk is hereby directed to record said agreement in the public records of Broward County, Florida. SECTION 4: This Resolution shall become effective upon adoption. KONTOGIANNIS, AS TRUSTEE, 380 South Fifth Street, Suite 1, Columbus, Ohio, 43215 (Grantor) and the CITY OF TAMARAC, a Florida municipal corporation having an address at 5811 Northwest 88th Avenue, Tamarac, Florida, 33321, (Grantee). (Whenever used herein, the term "Grantor" and "Grantee" shall include the respective successors and assigns of the parties hereto, whenever the context so admits or requires). WITNESSETH: WHEREAS, Grantor is the owner of that certain real property located in Broward County, more particularly described as: Parcel "A" of "The Mainlands of Tamarac Lakes, Unit Fifteen", according to the,plat thereof recorded at Plat Book 713, Page 3 of the Public Records of Broward County, Florida. and as depicted upon Exhibit A attached hereto and made a part hereof, (hereinafter referred to as "Development; and WHEREAS, in connection with the development of the property described herein, the Grantor has created a paved street area of a "key hole" configuration at the southerly terminus of Northwest 70th Avenue for the purposes of providing a turn -around area as more fully depicted on Exhibit B, attached hereto and made a part hereof, and WHEREAS, Grantor is desirous of dedicating such paved property to the Grantee for the purposes indicated, NOW, THEREFORE, in consideration of the mutual covenants and benefits to be derived hereunder, the Grantor hereby dedicates to the Grantee that certain property described and depicted upon Exhibit B, attached hereto and made a part hereof, to have and to hold the same as and for a public roadway. In the event that the property dedicated hereby is not used for a public roadway, this dedication shall be deemed null and void, and title to same shall revert to the Grantor herein.
