R-84-4.-� 3 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 01-5 FOR A REVISED SITE PLAN FOR ASHMONT/KINGS 4 POINT; AND PROVIDING AN EFFECTIVE DATE. S WHEREAS, pursuant to the instructions of the City Council of Tamarac, 6 Florida, a public meeting has been advertised in accordance with applicable law 7 of the date, time and place of the meeting regarding the review of the application 8 for a revised development order by the applicant for development approval; and 9 WHEREAS, the City Council has examined and investigated the application 10 and staff recommendations; and the attached Development Review Status Sheet dated 11 6/8/84; and 12 WHEREAS, the City Council reviewed the revised development order and 13 accompanying documents at a public meeting; and 14 WHEREAS, the City Council has determined that the application is in 15 compliance with all elements of the Comprehensive Plan., or will be in compliance 16 prior to the issuance of a Certificate of Occupancy for the development that is 17 the subject of the application. 18 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 19 SECTION 1: That the application for approval of a revised site plan for 20 Ashmont/Kings Point, prepared by F & R Builders, Inc., revised May 7, 1984, to 21 reflect revised setbacks and meter room locations on Buildings F, fi and I, is 22 approved subject to the following conditions: 23 A. Construction is to be in complete compliance with the plans and 24 specifications submitted by the developer to the City of Tamarac as described in 25 Section IT of the Development Review Status Sheet and approved engineering drawings. 26 B. Commencement of construction shall be no longer than one year from the 27 date of this approval.. If the development does not commence construction within 28 one year, this approval is null and void unless an extension has been granted in 29 accordance with applicable regulations. 30 C. Reso. #3178 D. Additional conditions established in order to issue the revised development order are set forth as follows: 1. All prior conditions of approval by the City Council are still applicable. SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid., the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED this _.Z�day of 1984.
