Reso. �t3148 CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-84- A RESOLUTION APPROVING AND ACCEPTING A BLANKET INGRESS/EGRESS EASEMENT OFFERED BY SABAL TOWNHOUSE DEVELOPMENT CORP. FOR GOLF VILLAS AT SABAL PALM; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the blanket ingress/egress easement offered by Sabal Townhouse Development Corp.,for Golf Villas at Sabal Palm, is hereby approved and accepted, a copy of said easement being attached hereto as Exhibit A. SECTION 2: That the City Clerk is hereby authorized and directed to record said easement in the public records of Broward County, Florida. SECTION 3: This Resolution shall become effective upon adoption. PASSED, ADOPTED AND APPROVED this day of _ 1984. W I T N E S S E T H: Grantor for and in consideration of the sum of TEN ($10.00) DbI1ARS and other good and valuable considerations to it in hand paid by Grantee, the receipt of which is hereby acknowledged, does hereby grant and convey to Grantee, its successors and assigns, a nonexclusive blanket easement for ingress and egress purposes upon, under and across the following described land lying and being in Braward County, Florida, to wit: All of 'Sabal. Palm T wnhouse', according to the plat thereof, as recorded in Plat Book 107, page 21, together with a portion of that certain parcel of land in Section 12, Township 49 South, Range 41 East of 'Fort Lauderdale Truck Farms Subdivision', as recorded in Plat Book 4, page 31, (said parcel described in official Record Book 4910, page 497) all being recorded in the Public Records of Broward County, Florida, being more particularly described as follows: Beginning at the most northeasterly corner of said plat of 'Sabal. Palm Townhouse', said point also being on the easterly line of said parcel described in official Record Book 4910, page 497 and on the westerly line of 'Pagano Park Section 3' as recorded in Plat Book 55, page 20 of said Public Records of Broward County; thence north 00'50'47" east along said easterly line, a distance of 654.88 feet; thence north 89*09125" west along the north line of said certain parcel, a distance of 27.91 feet; thence south 00*50105" west along the west line of said certain parcel and along the easterly line of 'The Lakes of Carriage Hills' as recorded in Plat Hook 99r page 99 of said Public Records of Broward County, a distance of 654.88 feet to the north line of said 'Sabal Palm Townhouse'; thence south 89*09125" east along said north line, a distance of 27.77 feet to the point of beginning as indicated on Exhibit "A". Said lands situate, lying and being in the City of Tamarac, Broward County, Florida. Containing 11.082 acres more or less. This Blanket Ingress & Egress Easement is granted to Grantee for the specific purpose of access by Grantee, for Grantee to Provide municipal services to the above -described property such as utility services, fire protection, police protection, and emergency and other public safety services. It is acknowledged that Grantor, or its successors, intends to construct residential dwellings and other impxt7vements upon the above - described property, and nothing contained herein shall be deemed to pro- hibit or restrict Grantor or its successors form constructing any buildings or improvements upon the property, subject to the requirements of Grantee or any other controlling governmental, authority, and upon the construction of any buildings and improvements upon the property the easement created hereby shall be subject to such improvements as are constructed and shall be used by Grantee in a manner which is consistent with the buildings and improvements constructed upon the property and which, to the extent possible, will minimize interference with and will be compatible with the construction and use of said buildings and improvements.
