CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-84-jjj�,
A RESOLUTION APPROVING AND ACCEPTING A 12-FOOT
DRAINAGE FLOW-THRU EASEMENT OFFERED BY LENNAR
HOMES, INC., FOR THE BELFORT PROJECT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the 12-foot drainage flow-thru easement offered by Lennar
Homes, Inc., for the Belfort Project, is hereby approved and accepted, a copy of
said easement being attached hereto as Exhibit A.
SECTION 2: That the City Clerk is hereby authorized and directed to
record said easement in the public records of Broward County, Florida.
SECTION 3: This Resolution shall become effective upon adoption.

This Easement is made this day of May, 1984 by
Lennar Homes, Inc., a Florida corporation (the "Grantor")
in favor of the City of Tamarac, its successors and assigns
(the "Grantee").
W I T N E S S E T H:
For and in consideration of the sum of TEN AND 00/100
DOLLARS ($10.00), and other good and valuable considerations
in hand paid by the Grantee to Grantor, receipt of which the
Grantor hereby acknowledges, the Grantor, hereby gives, grants,
bargains, and sells unto the Grantee the right, privilege and
easement for Oxainage flo-thru
under and through the real property situate in the
City of Tamarac, Broward County, including but not limited to
the full right of ingress and egress for such purposes throughout
the real property more particularly described in Exhibit A attached
hereto and made a part hereof, (the "Real Property").
TO HAVE AND TO HOLD the same to the Grantee, forever subject
to the terms and conditions set forth herein.
Grantor hereby fully represents and warrants to the Grantee
it has good title to the Real Property and the power and authority
to grant the within easement.
This easement for the purposes described hereinabove is and
shall be a non-exclusive easement to the Grantee, and nothing
herein shall limit or prevent the use of all or any part of the
same by the Grantor, its successors and assigns, for any purposes
not interfering with or affecting adversely the use, occupation
and enjoyment thereof by the Grantee, provided that no building
or structures other than a driveway or parking area shall be
constructed or located thereon, nor shall anything herein prevent
or preclude the Grantor, its successors and assigns from using,
dedicating or conveying all or any part of the said easement; nor
shall anything herein prevent or preclude the Grantor, its successors
and assigns, from granting any other easement or easements,
covering all or portions of the Real Property, for any purpose
not interfering with the Grantee's use, occupation and enjoyment
of the easement hereby granted.
It is expressly provided that if and when the facilities
installed in any strip of the Real Property over which said
easement is hereby granted shall be discontinued or abandoned by
the Grantee, the Grantor shall have the right to immediately
repossess same and the easement hereby granted shall be terminated
as to such abandoned strip without any action on the part of the
Grantor.
IN WITNESS WHEREOF, the Grantor has executed this instrument
