R-84-11L A RESOLUTION APPROVING AND ACCEPTING AN INGRESS/ EGRESS ACCESS EASEMENT OFFERED BY LENNAR HOMES, INC., FOR THE BELFORT PROJECT; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: Temp. Reso. #3144 SECTION 1: That the ingress/egress access easement offered by Lennar Homes, Inc., for the Bel.fort Project, is hereby approved and accepted, a copy of said easement being attached hereto as Exhibit A. SECTION 2: That the City Clerk is hereby authorized and directed to record said easement in the public records of Broward County, Florida. SECTION 3: This Resolution shall become effective upon adoption. PASSED, ADOPTED AND APPROVED this R3 day of 1984. W I T N E S S E T H: For and in consideration of the sum of TEN AND 00/100 DOLLARS ($10.00), and other good and valuable considerations in hand paid by the Grantees to the Grantor, receipt of which the Grantor hereby acknowledges, the Grantor, hereby gives, grants, bargains, and sells, forever, unto the Grantees and their personnel consisting of law enforcement officers, fire rescue personnel, sanitation personnel and water and sewer utility personnel, the right, privilege and easement to enter upon, over, through and across the Common Elements (these portions of all of the Condominium Properties to be created by Grantor on the real property described on Exhibit A attached hereto and made a part hereof) and the Common Areas (those portions of the real property described on Exhibit A hereafter used and designated for the use and benefit of the residents in the development to be known as Belfort) to carry out their duties and to enforce all existing laws, ordinances and regulations. In the performance of any or all of the functions and duties described herein the Grantees and any governmental agency within the Grantees shall be relieved of any liability for any injury which may occur except for the negligence of either of the Grantees or their agents, servants or employees. The Condominium Associations and/or the Property Owners Association, responsible for the maintenance of the Common Elements and Common Areas within Belfort, shall be obligated to hold the Grantees harmless for all attorneys' fees incurred; provided, however, the obligation of the Condominium Associations and/or Property Owners Association shall not extend to the negligence of the Grantees or their agents, servants, or employees.
