Reso. # CITY OF TAMARAC, FLORIDA RESOLUTIONI NO. Fe,/-/72 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE 13ELFO RT PROJECT. DEVEIMFM T ORDER NO. 109 A1D PROVIDING AV EFFECTIVE DATE. 3142 WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the applica- tion -for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated 5/1 7/84 ; and WHE?TEAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WMEC-AS, the City Council has determined that the application is in com- pliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for any unit on the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY WE COUrICIL OF THE CITY OF TAN1ARAC, %9�r�4 SECTION 1: That the development described on the attached development review status sheet dated 5/1 7/ 84 is granted a development order to proceed subject to the following conditions: A. Construction is to be in ccmlete compliance with the plans and spec- ifications sutmitted by the developer to the City of Tamarac as described in Section IT of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year froze the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. T'he development order is assignable, but an assignment does not discharge any assignee frcm strict compliance with the order unless the City Council consents to modify any of the original requirements. Additional conditions established in order to issue the development order are set forth as follows: 1: All development being consistent with the final site plan. 2: No building permit is to be issued for any phase other than Phan: 1, prior to Council approval of a Water & Sewer Agreement amendment and payment of appropriate fees (ERC fees, engineering fees and bonds). 3: No building permit for recreation area to be issued prior to rezoning to S-1. 4. Approval is also conditioned upon Council approval of the Water & Sewer Agreement, Flow-Thru Easement and Ingress/Egress Easement.for public safety. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall detenn ne if the other portions of the order remain valid or whether the approval shall be null and void.
