R-84-� 3 A RESOLUTION OPPOSING LEGISLATION INFRINGING UPON THE RIGHTS OF LOCAL GOVERNMENTS TO 4 REGULATE LAND USE AND OCCUPANCY OF MOBILE HOMES THROUGH LOCAL ZONING AND USE LAWS AND 5 . _ _ _ AND PROVIDING AN EFFECTIVE DATE. 6 WHEREAS, there is pending before or under consideration by the Legislature 7 of the State of Florida certain legislation relating to local governmental zoning 8 on land use and occupancy, ostensibly for the purpose of regulating placement of 9 mobile homes; and 10 WHEREAS, local land use and occupancy, and regulations thereof by zoning 11 at the local government level is a right conferred by the Municipal Home Rule 12 Powers Act, Chapter 166, Florida Statutes, and is properly a matter reserved to 13 local governments; and 14 WHEREAS, the City Council of Tamarac, Florida, is opposed to such legisla- 15 tion and desires to officially record its opposition with the State Legislature; 16 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 17 SECTION 1: That the City Council of the City of Tamarac, Florida, does 18 hereby record its opposition to the enactment of state legislation relating to 19 local land use, occupancy and regulation which infringes upon those powers 20 specifically reserved to local governments pursuant to Chapter 166, Florida 21 Statutes. 22 SECTION 2: That the Legislature of the State of Florida should not 23 infringe upon the rights, duties and responsibilities of local government through 24 the guise of legislation directed to the interests of any group, class or industry 25 to the detriment of residents to whom local government is directly responsible and 26 to whom it must be responsive. 27 SECTION 3: That the City Clerk is hereby directed to forward this Resolu- 2$ tion to the Broward County Legislative Delegation, the Florida Legislature, and to 29 other municipalities in Broward County. 30 31 32 1 33 34 Temp.
