R-84-'_o 3 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER NO. 01-4 FOR A REVISED SITE PLAN FOR ASHMONT/ 4 KINGS POINT; AND PROVIDING AN EFFECTIVE DATE. 5 WHEREAS, pursuant to the instructions of the City Council of Tamarac, 6 Florida, a public meeting has been advertised in accordance with applicable law of 7 the date, time and place of the meeting regarding the review of the application for 8 a revised development order by the applicant for development approval; and 9 WHEREAS, the City Council has.examined and investigated the application 10 and staff -recommendations; and the attached Development Review Status Sheet dated 11 5/9/84; and 12 WHEREAS, the City Council reviewed the revised development order and 13 accompanying documents at a public meeting; and 14 WHEREAS, the City Council has determined that the application is in compli- 15 ance with all elements of the Comprehensive Plan, or will be in compliance prior to 16 the issuance of a Certificate of Occupancy for the development that is the subject 17 of the application. 18 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: 19 SECTION 1: That the application for approval of a revised site plan for 20 Ashmont/Kings Point, revised April 30, 1984, to reflect meter room additions to 21 Buildings A, B, H, I -I and 1-2, is approved subject to the following conditions: 22 A. Construction is to be in complete compliance with the plans and speci- 23 fications submitted by the developer to the City of Tamarac as described in Section 24 II of the Development Review Status Sheet and approved engineering drawings. 25 B. Commencement of construction shall be no longer than one year from the 26 date of this approval. If the development does not commence construction within one 27 year, this approval is null and void unless an extension has been granted in 28 accordance with applicable regulations. 29 C. Additional conditions established in order to issue the revised development order are set forth as follows: 1. All prior conditions of the City Council are still applicable. SECTION 2: Should any section or provision of this revised development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall. be null and void. SECTION 3: This revised development order as conditioned shall become effective immediately upon its passage.
