A RESOLUTION APPROVING AN AGREEMENT AND
DECLARATION OF COVENANTS OFFERED BY
LENNAR HOMES, INC., FOR THE KINGS POINT
PROJECT REGARDING THE MAINTENANCE OF
MEDIANS ON NOB HILL ROAD BETWEEN N.W. 77 STREET
AND N.W. 71 PLACE; AND PROVIDING AN EFFECTIVE
DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Agreement and Declaration of Covenants
offered by Lennar Homes, Inc., for the Kings Point Project concerning
the maintenance of medians on Nob Hill Road between N.W. 77 Street
and N.W. 71 Place, is hereby approved, a copy of said document being
attached hereto as Exhibit "A".
SECTION 2: That the appropriate City officials are authorized
to execute this document on behalf of the City.
SECTION 3: That the City Clerk is hereby authorized and
directed to record said document in the Public Records of Broward
County, Florida.
SECTION 4: This Resolution shall become effective upon adoption.

AGREE1MENT AND DECLARATION OF COVENANTS 1- �f

THIS AGREEMENT AND DECLARATION, made as of the
_,a• day of April,:1983, by and between the City of Tamarac
("City") and Lennar Homes, Inc., a Florida corporation, (the
"Declarant"), its successors and assigns, and for and on behalf
of Kings Point in Tamarac, Inc., a Florida corporation not -
for -profit formed or to be formed.
W I T N E S S E T H:
WHEREAS, Declarant is the Developer of the real
property known as Kings Point in Tamarac
WHEREAS, Declarant desires to maintain the landscap-
ing in the median over that portion of the dedicated public
right -of --way located on the real property more particularly
described on Exhibit "A" consisting of two (2) sheets (the
"Property"); and
WHEREAS, the City is willing to allow Declarant
to maintain the landscaping on the Property on the terms
and conditions herein contained.
NOW, THEREFORE, in consideration of the premises,
and such other good and valuable consideration, the receipt
and adequacy of which are hereby acknowledged by the parties
hereto, the parties agree as follows:
1. Declarant agrees and shall be obligated to
maintain all grass, planted trees and shrubs, plantings and
hedges together with all parts of any sprinkler system, includ-
ing but not limited to pumps, pipes and sprinkler heads located
or to be located on the Property described on Exhibit "A".
If Declarant, in the sole opinion of the City, fails to reason-
ably maintain the landscaping and/or sprinkler system on
the .Property in good condition, and Declarant does not in
good faith and with due diligence proceed to restore and
maintain the Property to its prior condition within fourteen
(14) business days after receipt of written notice from the
City so to do, the City may cause the landscaping and/or
the sprinkler system on the Property to be restored and/or
repaired to its prior condition and Declarant shall be respon-
sible for the cost and expense of same.
2. This covenant shall remain in full force and
effect and shall be binding upon Declarant and its successors
and assigns for an initial period of fifty (50) years, and
shall be automatically renewed for successive ten (10) year
terms thereafter unless released prior to the expiration
thereof by the City.
3. Any modification or assignment of this Agree-
ment shall be agreed to and executed in the same formality
as this Agreement. However, City understands and agrees,
notwithstanding the foregoing,,. upon receipt by City of certi-
fication from Declarant that the certificate of occupancy -
has been issued for the last residential
dwelling unit constructed by Declarant in the Kings Point in
Tamarac development, then the obligation defined in this Agree-
ment shall terminate for Lennar Homes, Inc.
4. This Agreement may be specifically or legally
enforced by the City and the prevailing party shall be entitled
to reasonable attorney's fees and costs in conjunction there-
with.
