A RESOLUTION ISSUING A DE,'VEiAPMENT ORDER FOR ME
TAMARAC FINA SERVICE STATION AND CONVENIENCE STORE
PROJECT. DEVEI '11 , ORDER N0. 0 7 3 AND PROVIDING
AN EFFECTIVE DATE.
M ERu-S., pursuant to the instructions of the City Council of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable',
law of the date, time and place of the meeting regarding the review of the applica-
tion -for a development order by the applicant for development approval; and
WHEREAS, the City Council has examined and investigated the application,
staff and Planning Commission recmriendations, and the attached Development Review
Status Sheet dated 4 / 21 8 3 ; and
M3 EAS, the City Council reviewed the development order and accompanying
documents at a public meeting; and
WHEREAS, the City Council has determined that the application is in com-
pliance with all elements of its Comprehensive Plan, or will be in compliance prior
to the issuance of a Certificate of Occupancy for any unit on the development that
is the subject of the application.
NOW, THEREFORE, BE IT RESOLVED BY WE COUNCIL OF THE CITY OF TAN%2AC,

SECTION 1: That the development described on the attached development rev
status sheet dated 4 21 8 3 is granted a development order to proceed subject to
the following conditions:
A. Construction is to be in complete compliance with the plans and spec-
ifications sul-mitted by the developer to the City of Tamarac as described in
Section II of the Development Review Status Sheet and approved engineering drawings.
B. c=nenoement of construction shall be no longer than one year from the
date of this approval. If the development does not cammenee construction within
one year, this approval is null and void unless an extension has been granted in
accordance with applicable regulations.
C. The development order is assignable, but an assignment does not
discharge any assignee from strict compliance with the order unless the City Council
consents to modify any of the original requirements.

D. Additional conditions established in order to issue the
development order are set forth as follows:
1 - The right-hand turn lane is to be expanded to include a
deceleration Lane on Prospect Road;
2 - The asphalt parking area in the rear shall be regraded.
The entire site shall be resurfaced with 1-1/2" of asphalt
over 8" of compacted limerock to accommodate heavy truck
traffic;
3 - Drainage will flow into the existing catchbasins at the
north end of the site as well as the culverts along
Commercial Boulevard;
4 - Slot culverts must be installed in both driveways for the
full width;
5 - The retention wall at the southwest corner (north side of
Commercial Boulevard) must be reinforced;
6 -- A portion of the 4-foot sidewalk must be replaced on the
eastern portion of the property to connect to the existing
sidewalk where it is broken. This must be sloped to avoid
the lip that now exists and grass must be cut to expose
the sidewalk;
7 - The development must be in conformance with the approved
variance of the Board of Adjustment, Petition #4-B-82;
8 - All air-conditioning equipment shall be placed below the
roof parapet;
9 - All gas delivery and trash removal shall be between the
hours of 8:00 a.m. and 5:00 p.m. as agreed by the oil
company, service station manager and dealer;
10 - During gas delivery, as much of the fumes as possible must
be eliminated;
11 - There will be no on -site repairs, storage of cars, trucks oY
U-haul vehicles, and no car washing.
SECTION 2: Should any section or provision of this development
J order be declared by a court of competent jurisdiction to to be
invalid, the City Council shall determine if the other portions of the
order remain valid or whether the approval shall be null and void.
SECTION 3: This development order as conditioned shall become
effective immediately upon passage.

for variance is as follows:

Variance was approved with the following conditions:
1. That the amount of driveway openings be reduced from four to two. One
opening for the northeast conies', a two entrance driveway on the Prospect
Rd. side, the other opening on the southeast corner be changed to a
channelled driveway on the Ccunercial Blvd. side. The area width would
be 35' for the double driveway and 25' maxia m, each for the entrances channelled
off of CcmTercial Blvd.
2. Replace the louvered wall with a CBS wall not to exceed 8'.
3. Submit new landscaping drawings for Beautification approval in accordance
with the present Code, using the sketch on the board as same of the
reocmmendations by both the City Planner and the architect representing
Fina Oil Co.
4. New sod to the edge of the roadway, autrmatic rust free irrigation system.
5. No abandoned or wrecked vehicles stored on the property in question and no
major auto repairs or overnight parking.
