R-83-W88 A RESOLUTION ISSUING A REVISED DEVELOPMENT ORDER NO. 021-2 FOR A REVISION TO SITE PLAN NO. 2 FOR WOODMONT TRACTS 74/75 (BONAIRE) PROJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the applica- tion for a revised development order by the applicant for development approval;and WHEREAS, the City Council has examined and investigated the application, staff recommendations and the attached Development Review Status Sheet dated 4/7/83; and WHEREAS, the City Council reviewed the revised development order and 1, accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in com- pliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the sub- ject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revision to Site Plan No. 2 for Woodmont Tracts 74/75 (Bonaire), to show modification of location of town- house model unit, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and speci- fications submitted by the developer to the City of Tamarac and approved engineerinc drawings. B. Commencement of construction shall be no longer than one year from December 8, 1982, the date of approval of the final site plan. If the development does not commence construction within this time period, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. Additional conditions established in order to issue the development order are set forth as follows: l — The model unit is to be a minimum of 50—feet from the property line. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon passage. PASSED, ADOPTED AND APPROVED this lath day of April 1983.
