R-83-84 A RESOLUTION ISSUING A REVISED DEVELOPMENT ORDER NO. 014-2 FOR A REVISED SITE PLAN FOR TAMARAC GARDENS PROJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the applica- tion for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations and the attached Development Review Status Sheet dated 4/7/83; and WHEREAS, the City Council reviewed the revised development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in com- pliance with all elements of its Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the sub- ject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a revised site plan for Tamarac Gardens, to show revisions to Buildings A, A-1 and A-2, is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and speci- fications submitted by the developer to the City of Tamarac and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within thi time period, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not dis- charge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. Additional conditions established in order to issue the development order are set forth as follows: 1 -- All future internal or meandering sidewalks will be 3-feet wide unles specifically shown on the revised site plan to be 4-feet; 2 - All walks are to be concrete; no asphalt walks will be permitted; 3 - Extend 3-foot sidewalks to be continuous in front of the recreation area and to be continuous to all buildings; 4 - All ramps are to be adjacent to handicapped parking spaces and, if necessary, sidewalks are to be relocated to be contiguous with the ramps; 5 - Guardrail to be extended to the full width of the canal separating Tracts K and L according to City Code; 6 - Previous and present sidewalks require the extension of the guardrail and cost estimates are to be furnished and all fees are to be paid; 7 - As -built survey is to be furnished showing the property line, complete slope and bench at intervals of not more than l to 200'; 8 -- If the canal banks do not comply with City Code requirements, the developer shall provide either a separate bond or endorsement on an existing bonds to cover completion of the canal excavation; 9 - Landscaping fees will be calculated and are to be paid; 10 - Five (5) dumpsters will be relocated and two (2) dumpsters will be added; 11 - The directional sign will be relocated; 12 - A new site plan and mylar will be submitted showing the above condi- tions where applicable; 13 - No permits shall be issued until the new plan and mylar are submitted, the appropriate bond and all cost estimates are provided, and all fees are paid.
