RESOLUTION NO. R-83- f•2
A RESOLUTION APPROVING AND ACCEPTING A 15-
FOOT WIDE UTILITY EASEMENT FOR SANITARY
SEWER SYSTEM OFFERED BY GRANEK PROPERTIES
FOR THE LAKESIDE PLAZA PROJECT; AND PRO-
VIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the 15-foot wide utility easement for the
sanitary sewer system offered by Granek Properties for the Lakeside
Plaza project is hereby approved and accepted, a copy of said easement
being attached hereto as Exhibit "A".
SECTION 2: That the appropriate City officials are authorized
to execute said easement on behalf of the City.
SECTION 3: That the City Clerk is hereby authorized and
directed to record said utility easement in the Public Records of
Broward County.
SECTION 4: This Resolution shall become effective upon adoption.

(Whenever used herein, the term "Grantor" and "Grantee" shall include the
respective successors and assigns of the partieu hereto, whenewer the
context so admits or requires) .

WIE.AS, Grantor is the owner of that certain real property located in
Broward County, more particularly described in Exhibit "A" attached hereto,
(hereinafter referred to as "Servient Estate") and
MOOMS, Grantor desires to grant unto Grantee a non --exclusive easoen®t
to use a portion of the servient estate;
NOW, THEREYM, in consideration of the atom of M DOLLARS ($10.00) and
other good and valuable considerations paid by each of the parties hereto to
the other party, receipt of which is hereby aelmowledged by both parties, the
parties hereto do hereby grant and agree as follows:
1. Grantor hereby grants and conveys to Grantee, its successors
and assigns, a nor -exclusive easement over and upon the servient estate for
the installation and maintenance of public utilities.
2. Grantor reserves all rights not herein granted purmwt to
this easement, including but not limited to, the right of free ingress and
egress over and upon the servient estate and to grant further easements
under, over and on the servient estate; provided that, in no event shall any
of the rights herein reserved impede the easement herein granted or the
exercise of the rights of use thereunder.
3. The provisions of this easement shall be.b`.lndirig-cn the
parties hereto and the respective successors and assigns as a covenant

running with and binding upon the servient estate.
4. This easement shall not be released or altered without consent
of the Grantee.

lic Records of Broward County, Florida.
DESCRIPTION OF UTILITY EASEMENT:
A Public Utility Easement lying within Lot "B", LAKESIDE AT TAMARAC, as recorded
in Plat Book 115. Page 32, of the Public Records of Broward County. Florida, 15'
feet in total width, lying 6.0 feet on the northwesterly side of the center—
line and 9.0 ft. on the southeasterly side described as follows:
Commencing at the Northeast corner of LEADERSHIP OF TAMARAC PHASE ONE. as recorded
in Plat Book 76, Page 35, of the Public Records of Broward County, Florida; thence
N 00012'12" W along a projection of the East Line of said LEADERSHIP OF TAMARAC
PHASE ONE. 15.00 feet; thence N 89015142" W. 5.00 feet to the Point of Beginning
of the Centerline of the Easement herein granted; thence N 44019156" E. 83.51
feet to an intersection with the Southwesterly boundary of the Cul-de-Sac at
