Reso.# 2656 CITY OF TAMARA�C,, FLORID RESOLUTIOI`I NO. A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR THE WEDGEWOOD RECREATIONAL PARCEL PROJECT. DEV=M=, ORDER N0. 072jAND PROVIDING AN EFFECTIVE DATE. M2T ,AS, pursuant to the instructions of the City Council of the City of Tamarac, Florida, a public meeting has been advertised in accordance with applicable; law of the. date, time and place of the meeting regarding the review of the applica- tion -for a develax ent order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission reoa-dations, and the attached Development Review Status sheet dated 3 / 10 / 8 3; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEFEAS, the City Council has determined that the application is in ccrr pliance with all elements of its Comprehensive Plan, or will be in ccrrpliance prior to the issuance of a Certificate of Occupancy for any unit on the development that is the subject of the application. FLORIDA: NOW, THEREFORE, BE IT RESOLVED BY TEIE COUPICIL OF THE CITY OF TAMIARAC, SECTION 1: That the development described on the attached development status sheet dated 3/1 0/33 is granted a develo meet order to proceed subject to the following conditions: A. Construction is to be in camplete ca pliance with the plans and spec- ifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year fram the date of this approval. If the development does not comTence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee .frcm. strict compliance with the order unless the City Council consents to rudify any of the original requirements. Additional conditions established in order to issue the development order are set forth as follows: SECTION 2: should any section or provision of this development order be declared by a court of caupetent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
