R-83- c32 A RESOLUTION APPROVING EXECUTION OF A LETTER OF AGREEMENT WITH THE BROWARD COUNTY SHERIFF'S OFFICE ACKNOWLEDGING THE POLYCIES AND PROCEDURES ESTABLISHED WHICH GOVERN CASH APPEARANCE BOND RECEIPTS; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC. FLORIDA: SECTION 1: That the appropriate City officials are hereby directed and authorized to execute a Letter of Agreement with the Broward County Sheriff's Office acknowledging the policies and procedures established regarding the use of "cash appearance bond" receipt books and the delivery of the cash funds to the Sheriff's Office, a copy of said Letter of Agreement being attached her6to as Exhibit "A". Attached is a copy of the procedures that are utilized by the Sheriff's Office to control and account for the "cash appearance bond" receipts (form no. 57-10). Before these receipts can be issued to your agency it will be necessary for an authorized representative of your agency (Chief of Police, Mayor, City Manager or City Clerk, etc.) to sign below. As the authorized representative of CITY OF TAMARAC , it is agreed that employees and agents of the city will conform and follow the procedures set forth by the Broward County Sheriff's Office regarding the use of "cash appearance bond" receipt books and the delivery of the cash funds to the Sheriff's Office. Writes letter to Finance Division requesting that they be issued Cash Bond Receipts. Finance Division 2. Approves/disapproves request. If approved, sends Letter of Agreement to Municipality. Municipality 3. Signs Letter of Agreement (Exhibit 1) and returns same to Finance Division, who keeps Letter on file. Municipality 4. Sends representative to Finance Division to obtain Cash Bond Receipt Books (up;to,five (5) books). Finance Division 5. Checks to see if Letter of Agreement is on file. If so, Cash Bond Receipt Books are issued in numerical order. Finance Division 6. Logs books issued on Form 57-19 "Record of Pre -Numbered Forms". SEE NOTE Municipality 7. Representative signs Form 57-19 acknowledging receipt of .logged books. Municipality 8. Returns used books to Finance Division. Finance Division 9. Logs the date and books returned in applicable space on Form 57-19. Finance Division 10. Files used books in numerical order in File awaiting audit. However, in order to avoid any misunderstandings or misinterpretations, the following guide- lines have been prepared. 'A copy of a Cash Appearance Bond has been attached; each blank space has been numbered to correspond with the following items. I. "BROWARD"will be printed in this space. 2. The Defendant's name will be printed as follows: Last name, first name, middle initial. If no middle initial, please print NMI. 3. Defendant's current address. ` 4. Depositor's name in the same order as Item 2 will be printed if different from Defendant. If Defendant is Depositor, the words "SAME AS DEFENDANT" will be printed. 5. Depositor's current address will be printed if different from Defendant. 'If Defendant is Depositor, print words "SAME AS DEFENDANT". 6. "BROWARD" will be printed in this space. 7. The amount of bond will be printed in words, e.g., "FIVE HUNDRED & 00/100". 8. The amount of bond will appear in numbers, e.g., 11500.00". 9. The name of the County in which the Defendant must appear in court will be printed here, e.g. "BROWARD"; "ORANGE", etc. 10. The name of the city in which the Court is to be held will be printed here, e.g., "FORT LAUDERDALE"; "JACKSONVILLE", etc. 11. If Broward County Court appearance**, time must be filled in here, e.g., "10A" for 10:00 a.m. If out of County court appearance, the letters TBS, meaning TO BE SET, or TBN, meaning TO BE NOTIFIED will be printed. 12. If Broward County Court appearance**, the day of the month will appear, e.g. "5th". If out of County court, a line must be drawn through this space. 13. If Broward County Court appearance**, the month of Court date must be printed, e.g. "NOVEMBER". If out of County court, a line must be drawn through this space. 14. If Broward County Court appearance**, the year of Court date will be filled in this space, e.g. "83" for 1983. If out of county Court, a line must be drawn through this space. 15. The nature of the charge will be printed in this space. Although there are spaces for more than one charge, the policy of the Broward Sheriff's Office is to complete a separate bond for each charge. The information for com- pleting this space will be obtained from the arrest sheet or probable cause form. 16. The amount of the Bond will be filled in this space, e.g. ""500.0011. n 1 Page Two 17. Defendant must sign in this space. 18. Depositor must sign in this space(whether Defendant or different person). 19. If Defendant is Depositor, he must sign in this space. If Depositor is different person from Defendant he has the option of signing this or not. If no signature appears, a line must be drawn through this space. 20. The day of the month the bond is prepared is filled in this space, e.g.,2'5th". 21. The month the bond is prepared is printed in this space, e.g. "NOVEMBER". 22. The year the bond is preparedis filled in this space, e.g., ".83" for 1983. 23. The name of the Sheriff is printed in this space, e.g., "GEORGE A. BRESCHER". 24. "BROWARD" is printed in this space. 1 i 25. The Booking Division or Police Department personnel preparing the bond signs in this space. 26. The location where the bond is prepared is printed in this space, e.g. "BSO BOOKING DESK"; "HOLLYWOOD P.D.", etc. In addition to the above, the following items must be printed on the bond, if applicable. A. If the bond is an out of County bond, the County name will be printed directly under the words "CASH APPEARANCE BOND". B.
