CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-83-�g
A RESOLUTION APPROVING AND ACCEPTING A BLANKET
INGRESS AND EGRESS EASEMENT OFFERED BY CITY
NATIONAL BANK OF MIAMI, A NATIONAL BANKING
CORPORATION, AS TRUSTEE UNDER THE PROVIONS OF
THAT CERTAIN TRUST AGREEMENT DATED SEPTEMBER 14,
1978, AND KNOWN AS TRUST NO. 5003183-FOR WOODMONT
TRACT 72-C (PINEAPPLE PARK) PROJECT; AND PROVIDING
AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the blanket ingress and egress easement
offered by City National Bank of Miami, a national banking corpora-
tion, as Trustee under the provisions of that certain Trust Agree-
ment dated September 14, 1978, and known as Trust No. 5003183 for
Woodmont Tract 72-C (Pineapple Park) Project, is hereby approved
and accepted, a copy of said easement being attached hereto as
Exhibit A.
SECTION 2: That the City Clerk is hereby authorized and
directed to record said easement in the public records of Broward
-
County, Florida.
SECTION 3: This Resolution shall become effective upon
adoption.

BLANKET INGRESS ANC EGRESS EASEMENT

This Indenture, made this )day of
between the undersigned Grantor, being the owner of the property herein described,
and the City of Tamarac, a municipal corporation existing under the laws of the
State of Florida, whose mailing address is 5811 N.W. 88th Avenue, Tamarac, Florida
33321, hereinafter referred to as Grantee.

Grantor for and in consideration of the sum of TEN ($10.00) DOLLARS and
other good and valuable considerations to it in hand paid by Grantee, the re-
ceipt of which is hereby acknowledged, does hereby grant and convey to Grantee,
its successors and assigns, a nonexclusive blanket easement for ingress and
egress purposes upon, over and across the following described land lying and
being in Broward County, Florida, to wit:
Parcel 72-C of WOODMONT TRACTS 72-A A 72-C, according
to the Plat thereof recorded in Plat Book 115, Page
22, of the Public Records of Broward County, Florida.
This Blanket Ingress and Egress Easement is granted to Grantee for the
saecific purpose of access by Grantee,for Grantee to provide municipal services
to the above -described property such as utility services, fire protection, police
protection, and emergency and other public safety services.
It is acknowledged that Grantor, or its successors, intends to construct
residential dwellings and other improvements upon the above -described property,
and nothing contained herein shall be deemed to prohibit or restrict Grantor or
its successors from constructing any buildings or improvements upon the property,
subject to the requirements of Grantee or any other controlling governmental
authority, and upon the construction of any buildings and improvements upon the
property the easement created hereby shall be subject to such improvements as
are constructed and shall be used by Grantee in a manner which is consistent
with the buildings and improvements constructed upon the property and which, to
the extent possible, will minimize interference with and will be compatible with
the construction and use of said buildings and improvements.
This Easement is executed by the undersigned as Trustee, under the provisions
of that certain Trust Agreement dated September 14, 1978, and known as Trust Number
5003183, solely in its capacity as Trustee, as title holder to the property described
above, and not in its independent corporate capacity and no liability hereunder may
be asserted against its independent corporate capacity or against any beneficiary of
the Trust for which the undersigned is Trustee under that certain Trust Agreement
dated September 14, 1978, known as Trust Number 5003183.
IN WITNESS WHEREOF, Grantor has signed and sealed these presents the day
and year first above written.
