SECTION 1: FINDINGS OF FACT
1. The property which is the subject of this Exception Permit
is owned by Mike and George Giourgas.
2. The property is located between Commercial Boulevard and
N.W. 57th Street at,6790 N.W. 57th Street.
3. The property is a developed parcel on which exists a vacant
retail establishment.
4. A revised site plan has been submitted for review by the
City Council, together with a Developers Agreement, which have been
reviewed and approved by this Council.
5. An application has been made for an Exception Permit from
the platting requirements of the City pursuant to the terms of Section
20-4 of the City Code which permits said permits for such land of size
and shape that is in strict conformity with the platting requirements
would constitute a hardship.
6. The City Council finds that an undue hardship to the Village
Mall would exist because of the time frames required for platting
and that since there is no intention to use the property for anything
other than the previous commercial use, that platting would serve no
useful purpose.
7. The City Council finds that granting of the exception would
not set a precedent in any way for other and unlike properties.
8. The City Council finds that such permit for exception to
platting requirements would not be detrimental to the interests of
the community.
SECTION 2: An Exception Permit from the platting requirements
of Chapter 20 of the Tamarac City Code is hereby granted subject to
the approval of the site plan and agreement by the Council of the
City of Tamarac and subject further to the condition that the work
contemplated by the plan and agreement is accomplished.
SECTION 3: This Resolution shall be effective upon adoption.
