A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR TfIE
SHELL OIL SERVICE STATION (NW 88 AVENUE & COMMERCIAL BLVD.)
PROJECT. DEVELOPME!T, ORDER NO. 066 AIM PROVIDING
AN EFFECTIVE DATE.
MIEREAS, pursuant to the instructions of the City Council of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable'
law of the date, time and place of the meeting regarding the review of the applica-
tion -for a development order by the applicant for development approval; and
AREAS, the City Council has examined and investigated the application,
staff and Planning Commission recommendations, and the attached Development Review
Status Sheet dated 12/23/82 ; and
WHERFAS, the City Council reviewed the development order and accompanying
documents at a public meeting; and
WHEP=., the.City Council has determined that the application is in com-
pliance with all elements of its Comprehensive Plan, or will be in compliance prior
to the issuance of a Certificate of Occupancy for any unit on the development that
is the subject of the application.
I FLORIDA:
NOW, THEREFOP.E, BE IT RESOLVED BY ME COUTCIL OF THE CITY OF TAIIIARAC,
SECTION 1: That the development described on the attached development
status sheet dated 12/28/82 is granted a development order to proceed subject to
the following conditions:
A. Construction is to be in complete compliance with the plans and spec-
ifications sukudtted by the developer to the City of Tamarac as described in
Section II of the Development Review Status Sheet and approved engineering drawings.
B. Commencement of construction shall be no longer than one year from the
date of this approval. If the development does not commence construction within
one year, this approval is null and void unless an extension has been granted in
accordance with applicable regulations.
C. The development order is assignable, but an assignment does not
discharge any assignee from strict compliance with the order unless the City Council
consents to modify any of the original requirements.

D. Additional conditions established in order to issue the development
order are set forth as follows:
1 - Council will, at a future date, resolve the question regarding
construction of the southbound right-hand turn lane on N.W. 88
Avenue;
2 - A new landscape plan must be submitted which will coincide with the
site plan whereby the changes in the service building and washbay
are included, and a corrected beautification fee schedule, if
required, must be submitted with no charge for landscaping installe
on Commercial Boulevard voluntarily.
SECTION 2: Should any section or provision of this development order be
declared by a court of canpetent jurisdiction to be invalid, the City Council shal3
determine if the other portions of the order remain valid or whether the approval
shall be null and void.
SECTION 3: This development order as conditioned shall became effective
immediately upon passage.
PASSED, ADOPTED AND APPROVED this 9th day of February , 1983.

Project subject to the requirements included in the Report and the following
conditions:
1. City So.uncil• to approve the ingress/egress easement .
2. City Council to approve the Water/Sewer Agreement ,
3. City Council to approve Water Retention Agreement.
4. Developer to donate $35,000. for traffic light at the northwest corner
of NW 57 St and NW 88 Ave.
5. Council must resolve question regarding construction of southbound right
turn lane on NW 88 Ave. F & R has agreed to construct same by agreement
with County.
6. Council to recognize that the original approval of the Special Exception
regarding one way out on Commercial Blvd, was determined to be technically
unfeasible since the driveway will also serve as an access to the property
to the west. Council is therefore requested to amend the original
Resolution No. 82-342 to reflect the revised vehicular ingress/egress.
7. Landscape plan must coincide with site plan,.
