HomeMy WebLinkAboutCity of Tamarac Resolution R-83-329introduced by V//j44/' Temp. #2957 1 CITY OF TAMARAC, FLORIDA 2 RESOLUTION NO..R-83--_ 7 3 4 A RESOLUTION ISSUING A REVISED DEVELOPMENT ORDER NO. 014-2 FOR REVISION TO SITE PLAN #1 FOR TAMARAC GARDENS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of 8 Tamarac, Florida, a public meeting has been advertised in accordance 9 with applicable law of the date, time and place of the meeting 10 regarding the review of the application for a development order by 11 the applicant for development approval; and 12 WHEREAS, the City Council has examined and investigated the 13 application, staff and Planning Commission recommendations; and 14 the attached Development Review Status Sheet dated 12/8/83; and 15 WHEREAS, the City Council reviewed the development order and 16 accompanying documents at a public meeting; and 17 WHEREAS, the City Council has determined that the application 18 is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the applica- 21 tion. 22 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 23 TAMARAC, FLORIDA: .24 SECTION 1: That the application for approval of a revision to 2.5 Site Plan #1 for Tamarac Gardens, revised November 9, 1983, to reflect a change.of building type and phasing, is approved subject 27 to the following conditions: 28 A. Construction is to be in complete compliance with the 29 plans and specifications submitted by the developer to the City of 30 Tamarac as described in Section IT of the Development Review Status r Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and 35 void unless an extension has been granted in accordance with ap- 36 plicable regulations. ■ <, Temp. 2�57 l C. The development order is assignable, but an assignment 2 does not discharge any assignee from strict compliance with the 3 order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: N v Pe- 8 9 10 SECTION 2: Should any section or provision of this 11 development order be declared by a court of competent jurisdiction 12 to be invalid, the City Council shall determine if the other 13 portions of the order remain valid or whether the approval shall be null and void. SECTION 3: This development order as conditioned shall become effective immediately upon its passage.
