CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-83-
A RESOLUTION PERTAINING TO DISPOSITION OF A WARRANTY
BOND POSTED BY MONTWOOD, INC., FOR THE WOODMONT TRACT
54 PROJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Montwood, Inc., as Principal, with The First National Bank of
Chicago, as Surety, has filed with the City Letter of Credit No. 1402-00302685 in
the amount of $65,181.20 to guarantee public improvements associated with the
Woodmont Tract 54 project; and
WHEREAS, the bond is due to expire and there is not properly completed work;
and
WHEREAS, the Principal has been notified that the work is not properly
completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the recitations as set forth above are true and correct.
SECTION 2: That the appropriate City officials are hereby authorized to call
Letter of Credit No. 1402-00302685 in the amount of $65,181.20 posted to guarantee
public improvements associated with the Woodmont Tract 54 project if the remedial
repairs are not completed on or before November 22, 1983, or if the bond has not been
extended by that date, or if an adequate cash bond is not received subject to the
approval of the City Engineer.
SECTION 3: That said Letter of Credit be released if the remedial repairs
are accomplished on or before November 22, 1983.
SECTION 4: This Resolution shall become effective upon adoption.
