R-83-310 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 086 FOR A REVISED SITE PLAN FOR WOODMONT TRACT 71 (GOLF POINTE); AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of 8 Tamarac, Florida, a public meeting has been advertised in accordance 9 with applicable law of the date, time and place of the meeting regard- 10 ing the review of the application for a development order by the 11 applicant for development approval; and 12 WHEREAS, the City Council has examined and investigated the 13 application, staff and Planning Commission recommendations; and the attached Development Review Status Sheet dated 10/13/83; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. 21 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, 22 FLORIDA: 23 SECTION 1: That the application for approval of a revised 9. site plan for Woodmont Tract 71 (Golf Pointe), revised September 15, 1983, to reflect a community pool on Lot 37 at the corner of N.W. 84 Terrace and N.W. 83 Avenue, is approved subject to the following 27 conditions: 28 A. Construction is to be incomplete compliance with the plans -- ._..-...... 29 _ and specifications submitted by the developer to the City of Tamarac 3,0 as described in Section IT of the Development Review Status Sheet and 1 approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable, 36 regulations. Temp. #2905 1 C. The development order is assignable, but an assignment 2 does not discharge any assignee from strict compliance with the 3 order unless the City Council consents to modify any of the original 4 requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1 - Green Kroll will not be .required to excavate lots 12 through 20 8 to the property line but will have to conform to slope and pay 9 retention fees for the area not excavated. 10 2 - Green Kroll is required to backfill lots 9, 10 and 11 to the 11 property line, with the slope to be on their property. 12 3 - Certificate of occupancy will not be issued for lot 9, where the 13 residence is now under construction, until the required back-- 3.4 filling, canal slopes and setbacks are satisfactorily completed .5 and conform with City Code. .6 4 - Building permits will not be issued for the remaining lots under discussion until canals are properly constructed for lots 9, 10 and 11. 3 5 - Letter is to be provided from the bonding company to the City, stating that the bond includes $2,400.00 for backfilling the lots i 6 - Approval is given subject to further review and clarification asl 22 to the correctness of all items submitted to the City as well as 23 final certification of costs. 24 7 - If shelf cannot be provided, according to Stipulation, a hold harmless agreement must be provided. SECTION 2: Should any section or provision of this develop- 27 ment order be declared by a court of competent jurisdiction to be 28 invalid, the City Council shall determine if the other portions of 29 the order remain valid or whether the approval shall be null and .30 void. 1 SECTION 3: This development order as conditioned shall become effective immediately upon its passage.
