R-83- � 4 5 A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR AMBASSADOR SAVINGS AND LOAN PROJECT. DEVELOPMENT ORDER NO.095 ; AND REQVIDING AB EFFECTIVE DATE, 8 WHEREAS, pursuant to the instructions of the City 9 Council of the City of Tamarac, Florida, a public meeting 10 has been advertised in accordance with applicable law of the 11 date, time and place of the meeting regarding the review of i 12 the application for a development order by the applicant for 13 development approval; and 14 WHEREAS, the City Council has examined and investigated 15 the application, staff and Planning Commission recommend- 16 ations, and the attached Development Review Status Sheet 17 dated 9/29/83 and WHEREAS, the City Council reviewed the Development Order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- 21 cation is in compliance with all elements of its Compre- 22 hensive Plan, or will be in compliance prior to the issuance 23 of a Certificate of Occupancy for any unit on the development 24 that is the subject of the application. 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 26 TAMARAC, FLORIDA: 27 SECTION_ lI, That the development described on the 2P attached Development Review Status Sheet dated 9/29/83 is granted a Development Order to proceed subject to the following conditions: I A. Construction is to be in complete compliance with 1 the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the 34 Development Review Status Sheet and approved engineering 35 drawings. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The Development Order is assignable, but an assignment does not discharge any assignee from strict compliance with the Order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1. Installation of eight -foot wide sidewalk in front of this property, adjacent to gas station and in front of Richway property as indicated on both plans and agreed to by the applicant. 2. Applicant has voluntarily agreed to donate $4,340.00 for traffic light. 3. Median on University Drive to be backfilled to the top of the curb and sodded with Bahia. 4. Landscaping to be approved by City Planner. 5. Relocation of all hedges and trees now in the Richway drive- way and parking area subject to City Planner's approval. However, these hedges and trees must be used on the property 6. Landscaping in the median to be watered for not less than ninety days from installation to ensure a healthy growth, at which time the City will assume maintenance. SECTION 2: Should any section or provision of this Development Order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the Order remain valid or whether the approval shall be null and void. SECTION 3: This Development Order as conditioned shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this �j A day of L-AX1983.
