R-83-6 A RESOLUTION APPROVING AND ACCEPTING A UTILITY EASEMENT OFFERED BY ALL CARE MEDICAL GENERAL PARTNERSHIP FOR CENTRA CARE MEDICAL CENTER; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the utility easement offered by All Care Medical General Partnership for Centra Care Medical Center project is HEREBY APPROVED and accepted, a copy of said easement being attached hereto as Exhibit A. SECTION 2: The City Clerk is hereby authorized and directed to record said utility easement in the public records of Broward County, Florida. SECTION 3: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this day of `OY 1983. DIST.4:CIM KRANTZ: So WATER UTILITIES EASEMENT THIS WATER AND UTILITIES EASEMENT made this 13th day of September, 1983, by ALL CARE MEDICAL GENERAL PARTNERSHIP ,a Florida general partnership, with offices at 395 Douglas Avenue, Altamonte Springs, Florida 32701(GRANTOR) and the City of Tamarac, a Florida municipal corporation, with addresses at 5811 N. W. 88th Street, Tamarac, Florida 33321, (GRANTEE) (wherever hereto the terms Grantor and Grantee is included with respect to successors and assigns of the parties hereto, wherever the context so admits or requires). WITNESSETH WHEREAS Grantor is the owner of that certain real property located in Broward County more particularly known as: LOTS 9 and 10, Block 12, LYONS COMMERCIAL SUBDIVISON, NUMBER 3, Plat Book 76, Page 31, according to the Public records of Broward County, Florida as indicated on xhibit "A" attached. Being herein referenced as subservient estate. WHEREAS Grantor desires to grant unto Grantee nonexclusive easement to use a portion as a subservient estate. Upon that part of subservient estate that is not covered by buildings or appendages thereto. NOW THEREFORE, in consideration for the sum of TEN DOLLARS ($10.00) and other good and valuable consideration, receipt whereof is hereby acknowledged, the parties hereto agree as follows: 1. Grantor hereby grants to Grantee and its successors and assigns, a nonexclusive right over and upon that part of the subservient estate that is not covered by buildings or appendages for the instillation and maintenance of a water distribution system. 1$ 2. Grantor reserves all rights not herein granted pursuant to this Easement, including but not limited to the right of free use of egress and ingress over and upon subservient estate and to grant further easements over and upon said subservient estate; provided in no event shall such reservation of any rights impede the rights herein granted or the exercise of the right or use thereunder. 3. The provisions of this Easement shall be binding upon the parties hereto, their successors and assigns, as a covenant running with and binding upon subservient estate. 4.
