RESOLUTION NO. R-83- 2 S"I
A RESOLUTION AMENDING RESOLUTION NO. 82-268 REGARDING
ENGINEERING FEES REQUIRED AND DISPOSITION OF PERFORMANCE
BOND AND WARRANTY BOND REQUIRED OF H.L.R.,INC. FOR
NORTHWOOD II PROJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Resolution 82-268 released a performance bond in the
amount of $363,619.00 posted by H.L.R., Inc. for public improvements
for Northwood II upon payment of additional engineering fees due in
the amount of $5,414.26 and receipt of a one-year warranty bond in
the amount of $100,719.26; and
WHEREAS, the bonding company reduced the performance bond to the
amount of $100,719.26 as authorized by Resolution 82-268; and
WHEREAS, H.L.R., Inc. remitted additional engineering fees in
the amount of $3,164.26 instead of $5,414.26 as required by Resolu-
tion 82-268 and has requested clarification and amendment to said
Resolution; and
WHEREAS, the City Engineer has reviewed this request and has
recommended that Resolution 82-268 be amended to require additional
engineering fees in the amount of $3,164.26 instead of $5,414.26; and
WHEREAS, the City Engineer has also reviewed the work covered
under Warranty Letter of Credit No. 6101409 in the amount of
$100,719.26 posted by H.L.R., Inc. as Principal, with Continental
Illinois National Bank and Trust Company of Chicago, as Surety, and
has recommended release of said letter of credit subject to certain
remedial repairs being completed by September 22, 1983.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TAMARAC,FLQRI.DA
SECTION 1: That Section 1 of Resolution 82--268 is hereby amende(
to provide as follows:
"SECTION 1: That the Bond No, 6101409 posted
by H*L.R., Inc., as Principal, and Continental
Illinois Bank and Trust Cow of Chciago as Surety,
in the amount of $363,619000 for public improvements

at Northwood II is HEREBY RELEASED, subject to

receipt of a one-year warranty bond in the amount
4
of $100,719.26 and payment of additional engineering
5
fees due in the amount of $3,164.26. "
.SECTION 2: That Warranty Letter of Credit No. 6101409 in
7
the amount of $100,719.26, posted by H.L.R., Inc. as Principal,

with Continental Illinois Bank and Trust Company of Chicago, as

Surety, for public improvements at the Northwood II project, is
10
hereby released subject to completion of certain remedial repairs
11
being accomplished on or before September 22, 1983, as ..requested
12
by City Engineer Letter #0883-44 dated August 25, 1983.

SECTION 3: - That if the remedial repairs referred to in
14
Section 2 above have not been completed by September 22, 1983, and
15
if an extension has not been provided to said letter of credit,then
16
the appropriate officials are hereby authorized and directed to
17
call said letter of credit.
SECTION 4: This Resolution shall become effective upon
adoption.
