R-83-o2y' A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN EASEMENT AGREEMENT OFFERED BY TAMARAC HOSPITAL CORPORA- TION, INC., FOR MAINTENANCE OF A FENCE AT UNIVERSITY COMMUNITY HOSPITAL; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute an. Easement Agreement with Tamarac Hospital Corporation, Inc., for main- tenance of a 6-foot high concrete fence,at University Community Hospital, a copy of said agreement being attached hereto as Exhibit "A". SECTION 2: That in the event the fence is not repaired and maintained the City may cause the repairs to be made with the cost of such repairs to be borne by the Grantor and the City may place a lien on the property reflecting the value of any repairs which lien may be foreclosed as set forth in the Florida Mechanics Lien Law. SECTION 3: That the City Clerk is hereby directed to record said Easement Agreement in the public records of Broward County, Florida. SECTION 4: This Resolution shall become effective immediately upon adoption. PASSED, ADOPTED AND APPROVED this day of 1983. WITNESSETH. WHEREAS, Grantor is the owner of that certain property legally described as PARCELS "B" AND "C" OF UNIVERSITY HOSPITAL, accord- ing to the Plat thereof, as recorded in Plat Book 102, Page 50, of the Public Records of Broward County, Florida, (hereinafter referred to as "Property"), and WHEREAS, Grantor desires to erect a six foot high concrete fence which was approved by Grantee on 27th day of July, 1983, as an optional design of a wall pursuant to Sections 6-12(b)(5) and 6-45(b) of the Tamarac City Code. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, IT IS AGREED AS FOLLOWS: SECTSECT-�T Grantor by these presents does hereby give and grant to Grantee the irrevocable easement to go upon Grantor's property to maintain the fence in the event Grantor fails to maintain same and the fence is in dis- repair. Prior to Grantee entering upon the Property and repairing the fence, Grantee shall give to Grantor a five (5) day notice of Grantee's intention to take such action. In the event Grantor does not cause such repairs to be made and Grantee makes such repairs, the cost and expense of such repairs shall be the responsibility of the Grantor and Grantee may place a lien on the Property reflecting the value of any repairs to the fence which lien may be foreclosed in the manner set forth in the Florida Mechanics Lien Law. -1- SECTION 2 This Easement is irrevocable.
