B. Cc mencement of construction shall be no longer than one year from the
date of this approval. If the development does not commence construction within
one year, this approval is null and void unless an extension has been granted in

C. The development order is assignable, but an assignment does not
discharge any assignee from strict compliance with the order unless the City Council
consents to modify any of the original requirements.

A RESOLUTION ISSUING A DEVELOPMENT ORDER FOR UIE
TAMARAC MARKET PLACE
PROJECT. DEVELOPM�' ORDER NO. 0 91 AUDD PROVIDING
AN EFFECTIVE DATE.
WIIEREAS, pursuant to the instructions of the City Council of the City of
Tamarac, Florida, a public meeting has been advertised in accordance with applicable
law of the date, time and place of the meeting regarding the review of the applica-
tion -for a development order by the applicant for development approval; and
WHEREAS, the City Council has examined and investigated the application,
staff and Planning Commission recommendations, and the attached Development Review
Status Sheet dated 8 / 31 / 8 3 ; and
I-ERF.AS, the City Council reviewed the development order and accompanying
documents at a public meeting; and
w rAS, the City Council has determined that the application is in com-
pliance with all elements of its Comprehensive Plan, or will be in compliance prior
to the issuance of a Certificate of Occupancy for any unit on the development that
is the subject of the application.

D. Additional conditions established in order to issue the develognent
order are set forth as follows:
1. Approval is subject to all conditions listed on Page 4 of the Develop-
ment Review Status Sheet dated 8/31/83 and attached hereto;
2. Approval is also subject to curbing of the medians on both sides and
backfilling and sodding with Bahia grass.
SECTION 2: Should any section or provision of this development order be
declared by a court of competent jurisdiction to be invalid, the City Council shall
determine if the other portions of the order remain valid or whether the approval

Proposed development is/iin general conformance with Tamarac's Land
Use Plan Element and recommends:
Adoption of Development Order # �091 Master File # _ 13--80 For:
TAMARAC MARKET PLACE FINAL PLAT AND FINAL SITE PLAN
Project subject to the requirements included in the Report and the following
conditions:
1 Approval of development is subject to Council approval of the
Limited Waiver for 900 angle handicap parking spaces.
(to be heard Sept. 28, 1983) -
2. City Council to approve new Water/Sewer Agreement
3. All prior agreements relative to this parcel of land and prior
development proposals not revised by this order are still in effect
4 . Council to consider waiving sea wall requirements and constructing
1/2 canal at their south property line. '
5. Developer to provide temporary blanket easement for off -site draina
to be replaced with permanent easement after as-builts have been
accepted by the City, if any change, must be approved by City.
6. Council to approve landscape plan. Approval of plan should be
subject to the installation of landscaping in the public medians
adjacent to the property in accordance with the Beautification
Committee requirement.
7. All buildings shall be constructed of harmonious materials and colors
and design.
8. Canal connection to the east side of Nob Hill Rd is temporary and
permanent connection shall be constructed in the future .
9. Developer to indicate on site plan relocation of dumpster located on
the west side of the future Commercial Bank to the island to the east
of the bank -(presently encroaches in easement).
10. Developer to indicate on site plan the relocation of the lift statio
from the northeast corner of the project to the northwest corner and
revise the easements on the plat to reflect this relocation. The
mylarw of the site plan to reflect these two changes (items 9 and 10)

11. The developer has voluntarily stated that he will not permit a
convenience store in the shopping center.
